Comment: It would fair to say that Scalia is a scum bag that ought not be touched with anything less than a ten foot pole. He (it) is a shame fo the country. I shall now move on to much better things.
Rather than work to persuade his colleagues, Scalia seems comfortable marinating in his own rightness.

Comment: He is one of the members of the Supreme Court who put King George on the throne, an unforgivable and anti-democratic act.
Comment: What an useless article. Her opinion about his opinion. I wish I could get paid to write this trash. I could type out 10 of these a day and make great money. For those of you who have forgotten, the JUDICIAL branch is set up to verify that what is being done(laws, etc.) is constitutional. It was not set up for judges to make up laws themselves. That is what the LEGISLATIVE branch is for.
Comment: Mrbypass obviously never took a US government or history class. If so, he might know WHY the Supreme Court justices are not elected by the people. Just what our country needs - the people who are meant to interpret the Constitution to be turned into a bunch of politicians. Instead of having judges who interpret laws and decisions, we're going to have a bunch of candidates making promises to the people about how they plan to interpret laws. Great idea! As for Scalia - yes, he is a conservative judge, but when he says he uses "originalism" to interpret the Constitution, that's a real thing. It's something I remember learning about in my college modern government class - one I'm assuming Mrbypass (by passed education, I'm guessing??) didn't take. Because explaining why the Supreme Court justices are appointed for life and not elected for a term would take way too long, I suggest mrbypass find himself a high school government book to get these answers.
Comment: Another liberal who wants to change the constitution until it is in line
with Marx and his socialist views. Thank God for Ronald Reagen..
Comment: If we are going to get hacks on the bench, we should at least be able to vote for them ourselves.
We need a constitutional amendment to make the Supreme Court positions
elective.
Comment: If we are going to get hacks on the bench, we should be able to vote for them ourselves and select which hacks we want. We need a constitutional amendment to require the supreme court to run for election.
Comment: Lithwick writes about Justice Scalia's public statements, but I don't believe that is too important to her. Her real complaint is that he adjudicates; he doesn't legislate. And more importantly, he doesn't make laws that impose a far left political view on the country, and her kind just can't stand that. An American
Comment: Well said, Loyal American. That is exactly her real issue with the judge.
Comment: "Your kind" are so silly. -A different kind of American.
Comment: Scalia is an activist judge if ever there was one. He is narrow minded and not at all a Constitutionalist, but an egotistical, narcissist.. His need to promote his narrow views and interpretations of the law in the public square with the hope of influencing public opinion shows just how much of an activist he his.
Moroever, his recent response to a question on torture tells much about this man. Justice Scalia contended that, for example, to waterboard a suspect is not torture or cruel and unusual punishment because a suspect has not yet been found guilty. As a result what you do to him cannot be considered punishment. Thus, waterboarding in such a case is not punishment. Where does such twisted thinking come from? How much more warped could a justice's logic be?
Scalia, another fine example of the Republicans having placed a dangerous demagogue on the Bench.
Comment: Scalia is a jackass. The right wing shameless idiot.
Comment: Wow, thanks for adding such intelligence to the blog...we're certainly all better off for it. How about changing your name from "Thoughtful" to "Clueless"?
Comment: I really hate engaging in ad hominem attacks but this article was an irredeemably dumb fluff piece that entirely bypassed extremely significant issues concerning the interaction of the Court with the wider public. Justices traditionally have stayed out of the public eye in order to avoid polticizing the court. Scalia's relatively public persona compared to the other justices jeopardizes this position. Scalia's sitting down with the press to pitch his views and thereby shape the public debate creates an incentive for the liberals of the court to break their radio silence to do the same. Yet arguably the Court's legitimacy as the final arbiter of he law is predicated upon the public's perception that it is apolitical. If Supreme Court justices end up as talking heads on CNN and FOX News, that legitimacy would likely be impaired. There are potential benefits to the Court of greater public debate concerning the justices' varying philosophies in that many Americans and conservatives especially seem to believe that judges simply read their own preferences into the Constitution. My point however is that this article was totally non-responsive towards these issues and instead concerned itself with how Scalia is charming and sort of "kooky," a large opportunity cost as measured in the marketplace of ideas.
Comment: DAHLIA LITHWICK IS A LEFTIST HACK. BETWEEN THE A**-KISSING SMOOCH TO OBAMA/ATTACK McCAIN COVER STORY BY WOLFFE & THOMAS, TWEEDLEDUMB & TWEEDLEDUMBER, TO THIS CRAPPY PIECE BY THE ULTIMATE WHINER BOOSTER OF JUDICIAL ACTIVISM, DOES ANYONE CARE ABOUT THESE INCREDIBLY STUPID "MAINSTREAM & OBJECTIVE" MAGAZINES ANYMORE? BTW, YES, I KNOW I'M IN ALL CAPS; I'M TRYING TO PISS OFF YOU MINDLESS PROGS.
Comment: Wow, all caps??? You really know how to push our buttons.
Comment: OMG, more endless left-winger prattle from Dhalia Lithwick. My God, even her name sounds like something conjured up after too many mushrooms during a hippie "rap session" in 1960's Berkeley.
I have to go hurl now.
Comment: I think that Justice Scalia is becoming too big for his britches.
