    Comment: What an useless article. Her opinion about his opinion. I wish I could get paid to write this trash. I could type out 10 of these a day and make great money. For those of you who have forgotten, the JUDICIAL branch is set up to verify that what is being done(laws, etc.) is constitutional. It was not set up for judges to make up laws themselves. That is what the LEGISLATIVE branch is for.

    Comment: Mrbypass obviously never took a US government or history class. If so, he might know WHY the Supreme Court justices are not elected by the people. Just what our country needs - the people who are meant to interpret the Constitution to be turned into a bunch of politicians. Instead of having judges who interpret laws and decisions, we're going to have a bunch of candidates making promises to the people about how they plan to interpret laws. Great idea! As for Scalia - yes, he is a conservative judge, but when he says he uses "originalism" to interpret the Constitution, that's a real thing. It's something I remember learning about in my college modern government class - one I'm assuming Mrbypass (by passed education, I'm guessing??) didn't take. Because explaining why the Supreme Court justices are appointed for life and not elected for a term would take way too long, I suggest mrbypass find himself a high school government book to get these answers.

    Comment: Scalia is an activist judge if ever there was one. He is narrow minded and not at all a Constitutionalist, but an egotistical, narcissist.. His need to promote his narrow views and interpretations of the law in the public square with the hope of influencing public opinion shows just how much of an activist he his.

    Moroever, his recent response to a question on torture tells much about this man. Justice Scalia contended that, for example, to waterboard a suspect is not torture or cruel and unusual punishment because a suspect has not yet been found guilty. As a result what you do to him cannot be considered punishment. Thus, waterboarding in such a case is not punishment. Where does such twisted thinking come from? How much more warped could a justice's logic be?

    Scalia, another fine example of the Republicans having placed a dangerous demagogue on the Bench.

    Comment: I really hate engaging in ad hominem attacks but this article was an irredeemably dumb fluff piece that entirely bypassed extremely significant issues concerning the interaction of the Court with the wider public. Justices traditionally have stayed out of the public eye in order to avoid polticizing the court. Scalia's relatively public persona compared to the other justices jeopardizes this position. Scalia's sitting down with the press to pitch his views and thereby shape the public debate creates an incentive for the liberals of the court to break their radio silence to do the same. Yet arguably the Court's legitimacy as the final arbiter of he law is predicated upon the public's perception that it is apolitical. If Supreme Court justices end up as talking heads on CNN and FOX News, that legitimacy would likely be impaired. There are potential benefits to the Court of greater public debate concerning the justices' varying philosophies in that many Americans and conservatives especially seem to believe that judges simply read their own preferences into the Constitution. My point however is that this article was totally non-responsive towards these issues and instead concerned itself with how Scalia is charming and sort of "kooky," a large opportunity cost as measured in the marketplace of ideas.
