    Maybe if Mukasey started doing his job and stop covering Bushes' ass with his denials of supporting the EQUAL branch of government in the US Congress,i.e. subpoenas of Rove,Miers,Bolton,et al,then maybe they will at least listen to him. We thought we got rid of a national disgrace with Gonzalez? This guy is just as bad,will not carry out the tasks of the office.

      Typical Bush administration fear tactics, and even more typical Bush administration refusal to accept responsibility for their messes.

      But now that the Supreme Court has re-affirmed the writ of habeas corpus and the right to confront one's accusers, it seems inevitable that at least a few of these prisoners may end up being exonerated. Although Congress is correct that the issue of their innocence or guilt is a matter for the courts, if some of them are innocent,

      What DO we do with them?

      We can't send them back, and we can't keep them here, unlike the current Republican regime - they, unfortunately, WILL end up free on the U.S. streets in January of 2009.

        No they wont. Many will be repatriated to nations where they were picked up from. The reasons they haven't been is because of the crimes comitted against many of them. This Administration wants to just dispatch them to the gallows and repatriate corpses. The continued detention of many of these is simply to cover the torture, and other law-breaking such as kidnapping.

      When the smoke clears from a next horrible attack here, I will blame Bush for blowing off Bin Laden, and going off stealing oil. As for someone setting up cells elsewhere with impunity, that is such trash. Since 9/11, 7/7, Madrid, Bali, and others, the world has woken up. Germany, France, Britain and yes Russia are providing us actionable intelligence and giving us aid and assistance in this long-war.
      Now, I am not a big fan of Mr. Nadler either, but the Jabba refrence is what destroys the rest of your argument. Bush blew it. Cheney hijacked the policy and got Bush his "war" and I do well remember him saying He no lnger cared about Bin Laden, who attacked us.
      Mukasey is a continuation of the policy in lock-step with Bush. On the wall of his office is a picture of Eric Blair. Nothing could be possibly more telling. (Go use your Google...)

      Well, as I said, the tactic is fear. We talk of justice under our constitution and you are convinced that if we follow our own law in this "special" case, someone will cut off our heads. This crap has been going on now for years and it's time to stop it.

    Uhh Dollared. Actually we do. Indeed,this is the very thrust of the furor now being played out in Frisco. Despite the fact that the triggerman was actually arrested for another felony he had committed in March of this year and was known to be ''undocumented''he was released and not charged by the Frisco DAs office,who will be appearing shortly before a posse of federales with some 'splainin to do,as her idiotic decision[both Gavin Newsoms mayors office and the DA and the SFPD are now engaging in circular fingerpointing with what will be a gigantic lawsuit against the city looming],led to this massacre. As expected,not a single Democrat is saying anything regarding this horror with regards to corrective measure.. As equally expected,Republican Tom Tancredo[Co.] has already demanded a federal investigation of the whole Frisco gang and a final end to this ''sanctuary city'' nonsense.

    I don't understand. We are essentially assuming that they are all guilty, which means that they should all be in prison in the first place. But if they are guilty, why don't we try them first? If there is real evidence to prove their guilt (ie, not done under torture, etc.), it should be a fairly straightforward process to put them away in prison forever or however long their crimes merit. I think what this situation really means is that there is no evidence; or the evidence is scant. However, if that is true, they should never have been arrested in the first place. Our values are what make our country strong, our due process is what makes us our country just. If someone were locked up indefinitely in this country without any trial to prove their guilt (even to a lesser extent than reasonable doubt, there just hasn't been any trial at all), we would be outraged. The prisoners in GITMO may be enemy combatants, they may be guilty of crimes against us, including terrorism...but we must try them. If we violate our own principles we're no better than the terrorists. It should concern everyone when the attorney general is raising the specter of terrorists living among us...after all, if he had done his job, he would have demonstrated that everyone in GITMO deserves to be there. This would be a non issue if we were assured by due diligence on the part of the administration that they are in fact criminals. If we are wrong even once and have imprisoned innocent people for years, it would be a miscarriage of justice and our administration should be ashamed of itself. It is much like capital punishment...better to let a murderer go than to let an innocent person die. If in the unlikely event that one of these actual terrororists in GITMO make it to the U.S, who do you think really deserves the blame?

      Dead on the money.

      The point of due process is not to give the guilty a better chance to walk free, and it never has been. Under a due-process system, there are guilty people who go free. But there are a whole lot *less* innocent people who are wrongly imprisoned.

      Due process ties the crime to the punishment. Disconnect it, and you tie the crime to suspicion instead, or simply to the prejudices and offended mindset of the privileged classes.

      Our forefathers - the ones who fought the American Revolution - FOUGHT it in no small part to prevent the abuses of power going on by the British Empire caused by violation of due process. When due process goes, it's Americans truly forgetting where they came from.

      My only consolation in all of this is that it's not new. During both WWI and WWII it was actually a *crime* to criticize the government, much more so than today - particularly under the Alien and Sedition Acts of WWI. We *are* making progess by those standards - we're free to post critical comments on an Internet message board without too much fear of unjust imprisonment - so I still believe, even after all the abuses of the last eight years, that we are truly progressing as a nation.

    Newsweek printing an article about the Democrats doing a no-no!! I had to take a break and get me cold drink of water and come back to make sure I was reading it right.

      Conservatives all scream loudly about how "weak" liberals are, but the truth is, the conservatives are the ones gibbering with fear. Four thousand people die out of three hundred million and suddenly you all can't even think or see or talk without screaming about how we're all going to be attacked, hurt, killed, etc.

      Bigotry dies hard, but it's dying. There's a black man running for president with a wonderful chance of winning.         As a faux-Islamic-terrorist evil hypothesizing person type, I pose the following: suppose you tell me how you're going to react when your wonderful candidate becomes the face of the Great Satan and pays the appropriate price? Surely you don't buy the huge load of crap that Obama is going to modify millions of years of evolution and change human nature to the point that we'll all start getting along, do you? The only thing that has ever come close to doing that in the history of our country is a common foe, and partixanship has so much momentum here now that many prefer it to common foes even when they are real. Par example, I believe Islamic extremists are every bit as real as global warming. They are both long-term existential threats that are inconvenient for one political faction or another. To which tribe of ostrich do you belong?

    As these terrorists are released, the Demos will be lining up to register them to vote. Same as they do for criminals in prison and illegal aliens. Here in Chicago the Demos turned out the graveyard veto and have destroyed the Republican Party. We are a one party dictatorship here lead by major for life Dailey.     The mess is in the making! The Dems intentional release violent people onto the streets and and the intent is that these terrorists are freed AND ONTO THE STREETS of the USA and Europe. This is some smoke and mirrors ACLU and National lawyers Guild directioning of a kind they've done for years. The goal is to radicalize America or create conditions for this. The goal is to permit journalists some years from now to contact these released people and feature them in news stories. And for political purposes.
    This Liberal and Leftist move against the United States from within is the one that has American violent criminals in you're neighborhood and is permisive of the drug epidemic and would like to see our boarder security made useless.
    The release of the terrorists is a Part One of a plan with other following parts as yet not divulged to the public! Because you would not like it at all if you knew what the rest of the plan is at this juncture.

If the courts decide to relese these people send them home and try them there, or a close neutral country, for court!     If you have any concerns either way of giving enemy combatants constitutional rights and trials in US Federal Courts, at very least you should listen to what Mukasey says---after all he was the trial judge in the 1993 World Trade Center bombing case. If anyone is aware of the problems and the need for a reasonable solution, he is the most knowledgable
