OJ Simpson loses bid for new trial in Las Vegas
(LAS VEGAS) O.J. Simpson was denied a new trial Friday by the Nevada judge who presided over his conviction in the gunpoint robbery of two sports memorabilia dealers in a Las Vegas hotel room.
Clark County District Judge Jackie Glass said challenges raised by lawyers for Simpson and co-defendant Clarence "C.J." Stewart did not rise to the level of granting another trial.
"All of the issues have been preserved for the (Nevada) Supreme Court," Glass said, acknowledging her rulings could be appealed to the state's only appellate court.
Simpson and Stewart, who were shackled and in jail garb, did not speak during the 20-minute hearing, at which the judge also denied requests to release them on bail pending sentencing Dec. 5.
"They face life sentences, mandatory prison," Glass said. "Your motions are being denied."
Simpson, 61, and Stewart, 54, were convicted Oct. 3 of charges including kidnapping, armed robbery and assault with a deadly weapon in the hotel room confrontation on Sept. 13, 2007. Simpson has argued he was trying to recover stolen mementos.

Comment: OJ might as well appeal, he certainly doesn't have much to lose -- although annoying the state with the cost and hassle of another trial is almost a guarantee of adding more time, if not double, to the sentence they have in mind. I'm convinced this man must have some sort of mental imbalance, maybe the result of one too many hard tackles way back in his football days, because he's one of the most troubled ex-athletes in US history. Half the country believes he got away with murder and the rest thinks he might have, and I've yet to hear one person say he's innocent. And the rumor is he had an aquittal party all planned...
According to Chilly from Nevada, the robbery statute out there is pretty clear: the taking of property by force or fear. Agreed, it doesn't leave room to squawk about whos stuff it used to be or why the agressor thinks he should have it back. OJs behavior -- acting manacing and walking in with other armed men -- certainly seems to qualify under that definition. So what's to argue -- that he's OJ Simpson and we ought to believe him regardless of the facts?
Whatever happens, he brought it on himself and the Sympathy Meter is reading pretty low for the old has-been. He had the American Dream and turned it into a nightmare. Could've followed other ex-stars and retired right, sponsored a Pop Warner team or sold a line of mens clothing, but no... No Drean team this time, no celebs taking his side or offering opinions, and nothing in sight except the sunset though the barbed wire at Nevada State Prison. Hey, maybe he can do a remake of The Longest Yard and call it The Longest Fraud, the story of a foolish man who had it made and flushed his own life down the drain...

Comment: Having lived in Nevada for many years and being familiar with the law, I'll tell you the definition of robbery in Nevada: taking property by use of force or fear. That's it. There's no mention of who is the property's owner or whether they had a really good excuse for it. Although we hope our justice system is fair, the jury didn't have to consider anything from the California case at all. The only thing to consider was whether this incident met the elements of the crime. And it did, apparently. The celebrity who believes he is above the law is finally being held accountable for his actions. So of course his attorney is whining about it.
