Trouble in East Texas

It is frightening how quickly some of our fellow citizens will convict based on little or no evidence of guilt. This case sounded implausible from the get go. I suppose people have already forgotten the child abuse witch hunts of the 1980's such as the McMartin Day Care case in California. When you add in Nancy Grace type D.A.'s hell bent on a conviction and incompetent Judges then none of us are really safe from finding ourselves in a similar nightmare someday. Good luck Thad, I hope you can get some justice for these folks.

My name is Thad Davidson. I was Patrick Kelly's trial lawyer. A small army of unpaid lawyers and psychologists joined the Patrick Kelly Defense Team because of all of us believe, and still do, that my client is innocent and that he could not (and did not) receive a fair trial in Smith County, TX.

Before his trial Patrick Kelly had no prior criminal record. He had passed (with flying colors) a polygraph exam given to him by the toughest, most competent polygraph examiner I know, the same examiner the Smith County DA's Office has used for years (which superlative test results the DA's Office ignored, despite my repeated calls and faxes). The Defense Team put on the witness stand eight different swingers from the Mineola Swingers Club. All of them testified that no children had ever been in the Swingers Club. Further, the Defense Team put on the stand three young girls who the alleged child victims (Vs) in the case had told a TX Ranger that they (the three young girls) had been sexually abused right alongside the alleged child Vs in the Club, at the same time, same location, from the same alleged adult assaulters. The three young girls all testified for the Defense, however, that no one had ever abused them and that they had never been in the Club with anyone, much less the alleged child Vs in my client's case. The list of huge contradictions in the State's case that the Defense threw into the fight at trial is long, deep, and exhaustive. There has never been (and will never be) the slightest physical evidence, forensic evidence, or DNA evidence connecting Patrick Kelly to any of the alleged crimes against him . . . for the simple reason that he is innocent. It should be noted that the State refused to put the complaining witness in this case--Margie Cantrell--on the witness stand to testify against my client. Margie's husband, John Cantrell, has been indicted on child sex abuse charges in CA; John took the 5th in Patrick Kelly's case, although the judge did not inform the jury of this fact. Had the Defense Team called Margie to the stand, she would have pleaded the 5th or the Texas Rules of Evidence would have severely restricted our attack plan against her.

I am not permitted to freely voice my thoughts about the conduct of the judge and the prosecutor in this case. But there are many defense attorneys in TX who will gladly tell you what I cannot, as can a Houston Chronicle article written in 2001 by Evan Moore entitled "Justice Under Fire" (available online) about then Smith County DA Jack Skeen (who was 241st District Judge Jack Skeen in my client's case). I will say this: I believe my client would have received a Not Guilty verdict or a hung jury in any major TX city and in any major U.S. city. Patrick Kelly's case will be appealed.

Children are notoriously unreliable witnesses. They lie just like everyone else, especially when coaxed by their interrogators. This whole scenario just sounds very unrealistic. Child abuse does happen and should be severely punished but just make sure the people you lock up forever are actually guilty.

When you're on your knees, with your head bowed in prayer all the time. you never notice what the neighbors are doing. I know. I lived in a very small (2000 pop.), very religious town. We practically had a church on every corner and all social activities were church related. I lived a block each of three churches. We were in church every Sunday (twice) and Wednesday. Plus all the other activities. Yet I was sexually abused for 14 years. Plus the fact that my mother blamed me for taking her husband away from her a 4, so she tried to kill several times. Yet noone knew.

The presumption of guilt by the media and community at large on the Mineola sex club defendents before trial, precluded any reasonable attempt at a fair trial. Whether the defendants are guilty or innocent of the charges, everyone even the "pure evil" defendants are entitled to a fair trial. These children are scarred for life by parents who cared more for the drugs or money than their children. A couple of facts that do not seem right are John Cantrell taking the Fifth and Maggie Cantrell accusing the swingers of retribution in the case against her husband. The nature of her relationship to the children could include transference of events in her life to the children, i.e. John Cantrell abusing foster child. As a way to assuage guilt instead of turning in hubby turn in the trailer trash swingers. I am not saying this is true, but John "Santa" Cantrell fits the profile of a molester/pedophile.

This sounds like the same hysteria that swept the country during the 1980's. It is highly unlikely that this ever occurred. Chalk it up to the "religiously conservative Bible belt town" mentality. I hope I never have to live in a place like that.

Sounds like a new fall show for the three major networks. Why should this surprise anyone. We are living in a society that has rejected the truth of Gods word and Jesus Christ. A secular society that adores pornography, embraces homosexuality, a secular society that has dismantled the traditional family, kills the unborn and calls it a choice....
