    This story of the State Police commissioner seems improbable. He claims he was fired because he did not fire the brother-in-law as asked by the Governor Palin. It seems improbable that the Governor should even be dealing with the State Police Commissioner. Governor Palin should have contacted the local district attorney or state attorney general and have the case presented directly to a grand jury and thereby bypass the State Police Commissioner altogether. Because her ex-brother-in-law was a State Trooper maybe she felt compelled to exhaust internal channels and remedies due to her position as Governor and a desire not to embarrass the State of Alaska and state law enforcement, and so by that reasoning she decided to go initially through the State Police Commissioner. But the question becomes did the State Police Commissioner contact the FBI or United States Attorney or any outside agency such as an Alaska District Attorney or Assistant Attorney General because there was a potential violation of civil rights by the officer through the use of official oppression, his badge in harassing the Trooper???s estranged wife and threat to kill his father-in-law.

    Importantly the reports state that the estranged spouse filed for divorce and a domestic violence protective order on April 11 2005 against the State Trooper. Under new federal law, anyone subject to a protective order or convicted of misdemeanor domestic assault is subject to a ban on possession or use of a handgun for a minimum of five years or at least to the end of the protective order. Some have argued that the ban is forever even after the protective order expires. The Domestic Violence Offender Gun Band is a federal law that applies to everyone including police officers and servicemen and servicewomen. It is a felony to violate the law and the penalty is five years in prison. If subject to a protection order as alleged, the trooper should have been ineligible to be a State law enforcement officer and it would have been a slam dunk to terminate him. It would be a felony for the brother-in-law trooper to wear his standard sidearm if subject to a protective order. The State Police Commissioner should have been aware of this law and should have terminated the brother-in-law without being asked. The State Commissioner failure to uphold the federal law should have been enough grounds for his own termination.

    The Domestic Violence Offender Gun Ban is federal criminal law which the Alaska State Public Safety Commissioner had no discretion in not enforcing. If the State Trooper had a protective order issued against him, the State Public Safety Commissioner should have terminated the State Trooper without being asked by anybody. It is a felony to violate the federal Domestic Violence Offender Gun Ban. News reports state that the estranged spouse filed for divorce and a domestic violence protective order on April 11 2005 against the State Trooper. Protective orders are customarily issued. If a protective order was issued, the federal criminal statute Domestic Violence Offender Gun Ban should resolve all of the current controversy surrounding any inappropriate contacts between the Governor???s office and the State Public Safety Commissioner. If a protective order was issued, the State Public Safety Commissioner is clearly way out on a limb on the wrong side of the law in this matter. It would take one call to the court to find out if a protective order was issued and that would have been enough for the Public Safety Director to act.

    So let me see if I've got this straight???

    The state senator in charge of the investigation has admitted that his statements were inappropriate so another legislator asks that the bipartisan Legislative Council consider removing him in order to ensure the perception of fairness and due process. Sounds like a reasonable request to me no matter who the accused is. But the shrill angry left cries foul. I'll bet they wouldn't be so noisy if it were one of their own that was being scrutinized.

    An earlier poster was absolutely correct when he/she cautioned you screamers to keep your eye on the ball. This subject has no legs with the people who are going to decide this election because they view Wooten is a scum-bag who should have been fired a long time ago and the commissioner as protecting one of his own.

    I rather like how the article only specifically referred to "allegations" that Wooten had tasered his stepson and illegally shot a moose, thus creating a patina that Wooten wasn't all that bad, and so any expressed comments of concern by the Palins could be seen as pettiness. In reality, of course, Wooten had (no mere "allegation," but actually fact), among other things, tasered his stepson, been caught drinking in a patrol car, and threatened to have his father-in-law "eat a <expletive> lead bullet" if he helped his daughter in the divorce. And, of course, all of this was known when he was punished with a 5 day suspension (reduced from 10 days after the troopers' union complained). Now, I don't know about other people, but while the tasering and drinking might only warrant suspension (though for more than 10 days), I'm rather disturbed that a state trooper making death threats would be treated so cavalierly by the powers that be.

    Oh, and I can't help but notice that you didn't mention that the tape recording showing Bailey asking about Wooten (after Palin had denied any officials were involved) had been released by Palin herself, after an investigation she had launched into the matter, and the release was part of an apololgy on her part for being mistaken in her earlier denials (she had been unaware of the actions of others when she made her first statement).

    But if you reported any that, it wouldn't leave the impression of a petty, vindictive woman ready to abuse her power, and you wouldn't want to do that, would you?

      First off, Wooten has never been convicted in court for any of the things you allege, although he has admitted to them and was administratively disciplined for them. Legally, until convicted by a court of law, they are still allegations. This is something that reporters do have to pay attention to, there are libel laws after all.

      Secondly, the story is about quashing an investigation, not whether Wooten deserved firing or not. It appears McCain is try to do the same thing that Palin is being investigated about - using political power or clout to achieve some end that primarily benefits his own interests. This is certainly newsworthy, it reminds me of Gonzales firing the US Attorney because Pete Domenici didn???t get the indictment he wanted at the time he wanted it, although it doesn???t rise to the seriousness of that example.

      Palin???s willingness to use her clout to vindictively get some body fired seems to pair well with McCain, he???s tried it several times.

The man "overseeing the probe" was already chatting up Palin's Impeachment LAST July.

    Perhaps it's the comment he made saying that the results of the investigation are "likely to be damaging" to Palin? Results? I didn't realize you had "results" until you had a conclusion. Evidently, Mr. French has already reached HIS conclusion.

    Maybe it's the less than flattering comments he's made about John McCain? Or the very positive comments he's made about Barack Obama? Of course, Mr. French is, after all, an AVID supporter of the Democratic
    ticket. And while Mr. French is busying himself with speculation about Palin's impeachment , he's spoken glowingly about both Obama & Biden, even citing the fact that Biden has a son heading for Iraq. Coincidentally, so does Gov. Palin. But French seems to overlook that.

    I find it appalling that nowhere in this article do you delve into THESE issues. The very idea that Mr. French has ALREADY revealed he is far from impartial re: Gov. Palin (as fact that even HE readily admits) & that he is not simply "the Democrat overseeing the probe" but a Democrat-- that enthusiastically supports Mr. Obama-- overseeing the probe.

    Word is only just beginning to get out (no thanks to articles such as this) as to the players in this farce. By being less that forthright about who these players are & their histories, the media will appear to be covering for the Democrats. And the more Democrats insist that this "investigation" go forward, the LESS credible the results.

    There are many of us who will not sit idly by while Sarah Palin is pilloried yet again.
