    The court order related to the disparaging of Wooten to the children and in the community, That's why the court referred to it as a form of "child abuse." It was not a violation of the court order for the Palins to make the state police aware of Wooten's threats and potentially illegal acts (including killing a cow moose without a permit.) These were facts that the state police would be obliged to investigate and consider before deciding what action should be taken. There is a big difference between disparaging an individual (to lower in esteem; discredit or to speak slightingly of; show disrespect for; belittle) and the reporting of facts to the state police. In law the term disparage refers to "making an untrue statement that harms the reputation of another's business or product.." For Hosenball to say that the Palins attacked the character of Wooten by reporting his threats ot that they violated the court order by doing so is a gross misrepresenattion of the law.

    Tasering a child is obvious child abuse and a felony in most states. If there were any truth to those statements they woud certainly have been raised, under oath, in the trial.

    Releasing them to the press and not to the judge under oath suggests it is just a typical dirty trick in a nasty divorce.

    Truth is an absolute defense to libel, and it is highly unlikely that the judge would have issued any kind of cease and desist order to the Palins if it conflicted with a first amendment right.

    Palin seems to cherish the attack dog and barracuda images which are consistent with the tactics that she has appeared to have used against the trooper in a nasty divorce case.

    Cross this "lady" in DC and you will get a knife in the back. Great for bipartisan politics.

    I find it interesting that the media makes such a giant issue out of individuals (or government leaders) being concerned that an officer is still on duty who uses alcohol while on duty or tasers a child. If Sarah Palin had not lodged complaints or been concerned about Wooten, the media would likely be harassing her for NOT trying to do something. I can see the headlines now, "Did Sarah Palin allow a step-brother to remain on the police force when he should have been fired for behavior unbecoming an officer?" The reality is we have a liberal media that chooses to dig up SOMETHING to put in the headlines whether it is valid or not.

        In his interview on CNN, he admitted that the charge of killing the moose and tasering a 10 year old child was true. So, what do you think?

    I'm going to research how many Times, Molly Hacket [Palin's Sister], has been Married and does she have a Mental Illness or Drug & Alcohol Dependancies of Any Kind.

    I know Wooten has been Maried (4-Times) !!!

    Which is Very Common Behavior among (Rural, Southern & Mountainous People) Not to mention Alaska is a Haven for Domestic & Child Abuse, along with High Teenage Pregnacy !!!

    A spokesperson for the law firm that represented Palin's sister, now known as Molly Hackett, said Hackett's lawyer would have no comment because custody issues are still in litigation. Other lawyers representing Sarah Palin in connection with the state legislative investigation???which is examining whether she abused her powers as governor in trying to have Wooten fired or disciplined???had no immediate comment. Palin's official gubernatorial spokeswoman did not respond to e-mails and a phone message requesting comment.

    Wooten's lawyer also did not respond to messages requesting comment. John Cyr, executive director of the State Troopers union, who testified at the divorce hearing and is acting as Wooten's spokesman, said Wooten has avoided giving media interviews because he wants to avoid criticizing his former relatives (to date, Wooten has granted just one interview, to CNN).

    As the divorce case dragged on, the judge's concern about family "disparagement" appeared to deepen. In an order signed Jan. 31, 2006, which granted Palin's sister and Wooten a final divorce decree, Judge Suddock continued to express concern about attacks by Palin's family on Wooten. The judge even threatened to curb Palin's sister's child custody rights if family criticism of Wooten continued.

    In monitoring how a joint-custody arrangement worked out, the judge said in his order that he would pay particular attention to problems noted by a "custody investigator," specifically "the disparagement of the father [Wooten] by the mother [Molly Hackett, Sarah Palin's sister] and her family members."

    Wooten admitted that what he did with the taser was stupid, but was not an attempt to hurt the child. In fact, it did not the hurt the child. The taser was in "training" mode. All the Palin outrage about the incident was much later after he broke up with her sister.

    Oh Lord! Don't take all of this as fact you idiots! You have no clue what Wooten said to that family behind closed doors. I've also read other articles saying that he was NOT a good or nice man. I bet if he threatened YOUR family, you'd do anything you could to get rid of him. When its your family, you'd be surprised what you would do to protect them.

It was not a violation of the court order for the Palin's to tell Monegan or other state police officials about the threats that Wooten had made or potentially illegal acts on his part (illgeal killing of a cow moose.) Hosenball is trying to connect unrelated things to imply that Palin violated the court order. Whatever the Palins said to the state police (including Monegan) were issues of fact that had to be evaluated and considered by the State Police.

      Whatever they said were allegations - not "issues of facts". These types of cases are decided by judges and juries - not by the state patrol or uninformed outsiders.

    I suppose the judge was a Democrat too. This seems right in line with the Palin creed of an "enemies" list and herr pit-bull attitude. She clearly overstepped her bounds in having her staff step into a family custody battle. Whether this is a large or small offense will be determined, but she clearly overstepped her gubernatorial boundaries. No credible person would believe that a staff member would take it upon themselves to insert themselves into their bosses family custody battle. It may not be a huge thing (or it may be), but it's real!

    The trooper may not be a great guy and he may have been an idiot for doing a demonstration taser (at vastly reduced testing charge) on his 11-year old nephew, but this has been blown way out of proportion as part of the custody battle. I think what a custody investigator and the presiding judge have to say are far more credible than a partisan on a blog who picks and chooses what they wish to believe.

    If the BIL trooper made the threats, they should have come out in the trial.

    What we get from the trial is apparently the reverse - that the Barracuda and her family were making the threats - and that the accusations from the Barracuda and her family were unfounded..

    Cross this lady and you will get a knife in the back.

    That is clearly what we need in Washington to create a bipartisan consensus.

    She will make Cheney look like a wimp, with or without the lipstick.

      Actually, I am afraid to say that this is a fairly accurate description of her personality. In a personal interview with one of her colleagues in the state legislature, they talked about how she doesn't let anyone cross her and those that do get what's coming to them. She also described how she is not much into policy, but cares more about her pubic image. I know..very shocking! In addition, she tends to see things in black and white and views her decisions as a one way street. In other words, it's my way or the highway. And this is from someone that probably knows her way better than anybody in the lower 48. Basically, she is just like GWB and therefore a perfect fit for McCain.

    Given how courts reflexively favor mothers over fathers in custody cases it's encouraging to see a judge attempting to level the playing field for the guy. On the other hand it is outrageous to hold the mother accountable for anyone's actions but her own. (Can you control what your brother does or says?) Additionally, the legal test for disparagement is truth, meaning that if the statement is true, it's not disparagement. Seems like most of the statements made about this trooper have been proven true. Ergo, any discussion of disparagement, past or present, is moot.

    Of course Newsweek won't do the story about the Lead Investigator of "Troopergate" Hollis French, who before McCain announcement kept saying that Gov. Palin's office was being very "cooperative" now is changing his story and claims an "October Surprise."
    Mr. French has and is a Obama surrogate in Alaska....

    As The Stomach Turns - So Go the Days of Our Lives. It is truly the silly season.

    McCain wanted a diversion from having to talk about the issues, and he certainly got it. Any discussion recently about the economy? the war? health care?

    So Palin practiced crony-ism, used her power for personal persuasion, and got embroiled in family drama. Welcome to politics. Both parties do it all the time, let's not pretend we are shocked. And let's stop pretending it matters.

    Can we PLEASE focus on the issues? So she can skin a moose; can she balance a budget? She was a former beauty queen; is she a future negotiater on the international stage? She fired a public servant; can she nominate a supreme court justice?

    These are the important questions. Let's see if she has any answers.
