But we do know that at least SOME of the Gitmo detainees are dangerous, so the question becomes, what to do about them? Thats Obama's delema. I think a President Obama will find the right solution for this problem.

Are you really so sure that Muslims did 911? I mean there are enough explosive experts that disagree with the official story. There are dozens if not hundreds of experts, that say the WTC buildings, including building 7, were brought down with explosives. Building 7 was not even hit by airliners. It was the first steel structure building in the history of the world to collapse from a small fire. I am not going to speculate, but I think this alone needs a real investigation. There have been steel structure builkdings that have endured massive fires for over 24 hours, and did not collapse. 1 puny fire and the whole thing collapses? Taking out all the files on the Enron investigation with it as well??? It needs to be looked at.

Dude, would it be justice if even one of those given the option of sure death was innocent? Thats the basis of the American legal system. I have no problem punishing the guilty, but lets just make sure that the are actually guilty before punishment. Thats the real delema of Gitmo. Theres no real justice system. When the battle happens in your home town, and you are captures by US forces, it does not nessiarily mean you are a terrorist. Maybe it just means you are opposed to your home town of Jerrico Kansas being invaded by the Irianian government.

I agree Doc Howl. We constantly spout off how great America is. But I ask, what makes America great? One aspect, is out criminal justice system. By giving accused criminals due process, it gives them their best chance to make their case against evidence presented against them. Its the best process for determining who is guilty, and who is not. This process is not an obstacle. For it serves no purpose to incarecerate an innocent man.

Bush did an outstanding job post 9/11. Homeland protections were established. Laws to enable tracking of the terrorists were passed.The enemy was pursued on all fronts. We are safer today because of it. I pray that Obama can perform half as well. Guatanamo was one of the ways Bush protected us. Obama and others thought Guantanamo was a problem. He now has the responsibility to come up with an alternative system that will continue to keep us safe, or tell us that he was wrong. Expecting him to put action to his words is not unreasonable. Reminding him of that is the right thing to do.
Listen Toadboy, I understand that Bush did a lot to keep us safe. But much of what Bush did amounted to performing a surgical proceedure with an axe. My father, a died in the wool democrat, and patriotic American, who's family came to America hundreds of years ago in the very beginning of this nation, likes to write articles for Law Enforcement Magazine. My dad a biochemist, understands the threat of biological weapons. He writes articles for Law Enforcement Magazine to help educate those in Law Enforcement. My dad is an America loving good guy. Well, his FBI contact has told him, that because of his research into this area, he has been placed on a government "Watch List" along with terrorist suspects, and Ted Kennedy. His FBI Agent was not suspossed to tell him of this, but the agent knows damn well my dad is no terrorist, and warned him to be cmore careful in his choice of research sitesd he goes to. What a joke. You try to do some good, and the Busg Administration brands you as a terrorist. Geez, my dad is WHITE, not ARAB. Stupid is as stupid does. End of story.

It seems to me Mr. Ephron did a well-written and objective article on the Gitmo situation. Other posters have expressed concern about some of the responses here as not addressing the issues in an objective way, but engaging in what is known, in debate, as the "ad hominem fallacy," (which automatically loses the debate for the person attempting it).
Defined in simpler language... it translates as "against the man and not the issue," or the "name-calling fallacy.??? Using it advertises the individual???s lack of knowledge of facts and dearth of logical skill in his conclusions.
One commentator here questioned the educational system in the United States that produces people who think vulgar insults display their positions persuasively. As a school teacher I can attest to seeing young colleagues in the schools promoting grade inflation and a kind of blind-leading-the-blind process in the classroom where the teacher him/herself doesn't know the rudiments of the subject matter he is trying to teach. And this is in one of the best school districts in the state of California... our most populous area.
It is interesting the Ephron's article quotes sources who refer to inmates as "members of Al Queada," an acknowledged and self-defined Islamic terrorist organization. It seems to me the problem there is easy. This organization has publicly and repeatedly dedicated itself to killing everyone and destroying anything not Islamic, especially the United States, but also including Western Europe.
In other words, the "trial" is over with a conviction. Solution? Off with their heads. Pronto.

The reason Bush failed to punish some of these so called terrorists, Was because evidence of their wrongdoing was scant. Many of these so called terrorists were "caught on the battlefield." That sounds convincing enough to the distant American listener. But truth be told, it does no good to punish an innocent man. Many of these detainees, but not all, were captured in towns where these people lived. Towns were where these people lived, and simply being there , on the battelfield did not necessiarliry make you a terorist. But they were captured just the same. Just being there, in the town where you live, does not constitute evidence of terrorist wrongdoing. Thsats the problem with Gitmo. These oeople need criminal trials. In US court.

The article also fails to mention that Yemen disavows certain Yemenis in GITMO as being Yemeni, which makes some of them not returnable. The article makes it sound like the Yemeni detainees are our fault, when its is actually Yemen's fault. A couple of the Yemeni returnees have conducted further terrorist operations; moreover, the Yemen govt refuses to try terrorists. Other countries simply don't want some of them back. Last, there are several detainees in GITMO who don't want to go back, and their countries will not accept those who do not want to return. You also have 6 Bosnians, which the BH Government will not accept because of the ridiculous tri-authority system the Clinton Administration came up with.
Postings like these sure bring out of the woodwork a host of screwballs. Again it is truly sad that so much ignorance exists in our country. Guess our schools are truly failing when it would apper that many posts exhibit such distorted thinking and outright hatred. No logic at all!
Obama is not Bush, he will come up with a fair way to handle the detainees.
The Bush Administration has given them a way out. Any time you hold anyone without trial for this long you jeopardize conviction.
