In the typical case, prostitution is not a victimless crime. This case appears to be atypical, however. Ms. Dupre apparently did not come from poverty or abuse but simply wanted to earn easy money.
Spitzer was proscecuting johns under the theory that prostitution was a form of conspiracy to aovid appropriate payment of taxes. Again, this appears to be a bit of a stretch. The prostitution business was not paying taxes and Spitzer knew this. On the other hand, he was attempting just to get laid. Prostitution is for lazy, selish people who do not want to have to take the time for foreplay but can live out their narcissistic urges without worrying about someone else's pleasure. In other words, Spitzer was a jerk. As someone who believes that the government should stay out of morality when it involves high paid "workers", it was not a big deal that Spitzer did not go to jail. If on the other hand, Spi9tzer put other johns in jail, then he should have had to serve the same sentence that he forced them to serve. while I believe that the government should stay out of high priced prostitution, hypocricy is never appropriate.
