Religion was decreed as not part of our government from the outset. Laws are morality based, not Biblically based. The Bible contains laws that mirror the morality of societies since time immemorial. Remember the code of Hammurabi? Most societies contain similar laws because they all deal with the same situations-- human beings trying to live together. The Bible doesn't hold a premium on these. Bush's numbers by the way, are much lower than both Truman and Nixon, the 2 former 1st and 2nd place holders for disapproval ratings. Sticking to your guns when "your guns" were wrong is not really a virtue.

First off they did not create new law, they correctly ruled on exsting unconstitutional old law.
As for it being a "democratic court":
Engel vs Vitale was decided by a 6-1 vote with Warren, Harlan and Brenan, all nominated by Eisenhower, Douglas, Clark and Black were nominate by FDR and Truman. Therefore it was equally Republican and Democratic.
Abington School District v. Schempp was decided 8-1 with Warren, Harlan, Brennan being Republican nominees. And they were considered three top-flight legal scholars.

Bush leaves office with higher poll numbers then both Truman and Carter (democrats). Carter was by far the worst president of the last 60 years hands down. 17% mortgage rates, gas lines everywhere, 10% unemployment, US hostages in Iran, and on and on the list goes. He was as inept as he is nice. Bush stuck to his guns and did what he said he was going to do. If you remember 90% of citizens supported the was in the beginning. He could have been another Clinton and after 9/11 uttered those still repulsive words Clinto did after every terrorist attack while he was in office. We are going to hunt down these terrorists and hold them accountable. Followed by nothing until the next attack and then those famous words again. He could have had Bin Laden killed while in office and forced Israel to release Mohammad Atta in the Olson Accord prisoner exchange. Both of them repaid us for our generosity. Like it or not at least Bush did what he said he was going to do and not provide just lip service.

I do not hate Bush or the GOP. I have contempt for Bush and Cheney and what the GOP has allowed itself to become. I think you are were too young to remember the pardon of Richard Nixon by President Gerald Ford. The pardon was for impeachable offenses. So where does say impeachment is not pardonable? Or maybe it was all in the timing, is why things worked the way they did. With Ford taking office when Nixon was flying back to California. And then as soon as Ford was President , he filed the pardon for Nixon. So if you think you can get Bush in jail for all his crimes he has committed over the last 7+ years, you better have a fool proof plan.

I was a teenageer at the time and you did not understand what was said. Nixon was not impeached. He resigned before the proceedings and once he was no longer in office the impeachment procees stopped. Ford pardoned him for any cromes he may have committed that he could have been tried in criminal court for, outside of the impeachment.

Since there is no intention of impeaching Bush, he cuold still pardon himself for criminal charges not yet charged. But that is unlikely to happen, and he is unlikely to be charged in any US Court.

Actually the Federal prison system is badly broken. There are far too many non-violent offenders taking up time, space and tax payer $$. Since the abolishment of Federal good time and the creation of mandatory minimum sentences our prisons are busting at the seams for no good reason. We spend annualy some where in the neighborhood of 60 billion dollars to keep the prisons up and running and while some of that is necessary to keep the murderers, rapists, pedophiles and terrorists of the streets, that number could be greatly reduced by looking for alternatives to prison. Those alternatives could be in-home detention, longer terms of probation or parole for those offenders deemed non-violent. Having been personally affected by the Federal System I know that the right hand and the left hand in most of these Federal cases are not in sync and good people get stuck in a broken system to which there seems no end. As a country we have far more people in prison per capita than any other industrialized nation on earth. Tell me that's not wrong. If the non violent inmates could be dealt with in an alternative fashion, Guantanamo could be closed those detainees could be transferred to facilities on the mainland to await fair trials, current inmates could be sent home to their families and loved ones to be cared for at their own expense rather than tax payer expense and it would relieve the prison over-crowding.

just so you have your facts right LIbby wasn't pardoned his jail sentence was commuted big difference. Also if you knew the facts in the Border Patrol case they covered up the shooting initially and destroyed evidence. The shooting was secondary to the other actions.

Actually according to the US Constitution, the President can pardon "co-conspirators" and theoretcially even pardon himself. Whether the Us Supreme Court would uphold a self- pardon valid is a good question, but many Constitutional scholar think that they might. So yes, IF the criminal is the President they can issue pardons as long as they are in office.

Although I do think that Bush did engage in impeachable actions it would be a waste of time and effort to start impeachment proceedings now. There are more important things to focus on.

The pardon power was given solely to the Executive by the framers, who described it as the "Benign Perogative." It should remain untouched, no matter the recent abuses. If there is a political objection to pardons, one should ask a candidate prior to election what their pardon policy should be. Any diminuation of the pardon power removes a check against abuses by the courts and the possible punishment of the innocent. As for Clinton's filth, and the Libby issue, those should stain the issuer, not the process.
Checks and balances can be abused, as can passions. Care to observe both. -

That is nullification. It would require a retrial, which Judges do not grant, as it means they made a mistake in the first place. It becomes the path to no check against the court. You can not petition to remove an offender from Punishment, as you have no standing. Courts rarely hear "first-friend' cases.
Stare Decisis or let it stand is how our system works. Courts only tend to reverse based on errors of process, not fact. Look up the process to get a writ of certaori before the Supreme Court. Innocence is one of the reasons the court will NOT accept a case for review. Those are the rules of the court.
That is why Ramos and Compeon can only hope for relief from the same executive branch that abused them.
I would wish Obama to take up the clemency as soon as he took the oath.

Scooter Libbet was convicted of not telling the truth, in a case involving 'Who Leaked The Name Of Valerie Plame to Robert Novak", even though he KNEW who had leaked the name, BEFORE he started prosecuting the case. How did he know? Because Novak TOLD HIM, and Richard Armitage, the guy who DID IT, told him as well. 18 USC 1001. You can either claim the 5th and shut up, or tell the truth. You do not get the choice: "To Lie, Utter Falsehoods, with the intent to decieve."
All of the rest is not attributable to the specific act of uttering a falsehood under oath. It is additional window dressing that can distract, but not lawfully impact. It is irrelevant. Now a Republican prosecutor, appointed by a Republican Attorney General, to investigate a Republican, resulted in a conviction. I realize it is hard for a Republican to believe that any Republican could possibly get convicted under such circumstances, and frankly it boggles my mind, but it occured. Usually when Republicans stack the deck they get the cards they want. -

Pia, I agree with you but hope that he pardons the two border patrol agents. Their lives have been destroyed simply for trying to do their jobs and protect the integrity of our southern border.

Remember 9% still think Bush is one of the greatest presidents ever. They generally know squat about law, civics, history, philosophy, jurisprudence, precedent, and the other trappings of freedom and a secular government.
