I can feel you conviction, and support your right to it. I do, however, have one question...for clarification: If you were to awake and find that you were Rolando Cruz, would your opinion change?

Stop reaching for straws to keep Burris, the junior Senator from Illinois, out. He reassigned the case from Kenney - big deal!

In the interst of political integrity, both Governor Blagojevich should be removed and the Burris appointment be nullified.

You DO realize that political integrity is an oxymoron, right?....

In the interest of politcal integrity, both Governor Blagojevich should be removed and the Burris nomination should be nullified.

The article is an over simplification of a very complicated case and very unforunate case involving the deatf of a young girl. These men were twice convicted by juries. Dugan refuded to admit guilt without a plea bargin excluding the deat sentence. He was already in jail for murder. Could Dugan be believed? These men were ultimately found innocent which shows the system does work even if slowly. Don't be so quick to blame Burris for this situation. Look into the whole case before making a decision on his fitness to serve

What is it that you wish to examine further? Are you of the opinion that Prosecuter Kenney lied? Do you believe that Burris did NOT refuse to act? Do you believe that court officers were NOT charged with wrong-doing with regard to the Cruz case? Exactly what do you dispute that would make any rational individual decide that Burris is qualified to represent the people of Illinois? One, at least (Mr. Cruz) was not adequately served by Mr. Burris when he held an office that afforded just that opportunity. Please....explain.

    Burris? Baggage?

It's more like Burris is the latest article of baggage for Obama.

I'm picturing a caricature of Obama standing sadly at a airport baggage carousel; neck deep in baggage with the carousel bringing yet more bags. There's a little overnight sized bag kind of tumbling off towards him that says "Burris" which will only land on the much larger pile of bags labeled Blago, Ayers, Rezko, Chicago political machine, etc.

Beside him is a porter leaning lazily on a baggage cart with the word "Media" across his chest to identify him. The porter says "Don't worry. I won't charge you for any of that. I want to make sure you have a great trip."

"factual innocence" is rarely of concern to prosecutors, especially those (hopefully) few who lie and conceal exculpatory material. For them prosecution is (1) a game, and one in which they hold the cards when the defendant is poor since they have unlimited funds whereas public defenders are always underfunded; and (2) a stepping stone to advancement where being seen as "soft on crime" is a disqualifying element. Perhaps if we had the English system where acquitted factually innocent defendants are entitled to damages including compensation for unlawful imprisonment the system would be fairer for the poor.

I WONDER JUST HOW FAR THE MEDIA AND OUR GOVERNMENT POLITICALS WILL GO TO KEEP BURRIS OUT OF OBAMA SENATE SEAT ?

  • Posted By: pjdarling12 @ 01/03/2009 6:00:38 AM

I wonder how much time the officials who lied, and those who covered up or ignored those lies, will spend in prison. Their misdeed were not due to ignorance or misunderstanding. They knew that their words and deeds could very well lead to the death of an innocent person. If any of us did such a thng we could and likely would be charged with a crime. Tell me about justice.

Police, prosecutorial, and judicial misconduct is overlooked by State officials is a more common occurance than most people can imagine. During the same period of time (1991) Governor EVAN BAYH was involved in a similar case in Indiana -49G069001CF007921- which never got any publicity.

There is something very wrong with our system when someone else admits guilt and it does not automatically force a re-look at the original conviction. We even have cases where there is DNA evidence that points to someone else, yet zealous prosecutors cannot admit that a mistake was made. I have never understood why such situations do not force an automatic appeal, so that more senior judges can look at all new evidence and determine whether a new trial is warranted or even to move to free the person.
People like Burris are part of the problem - we do not need to promote people like that to Senator. It would be good to hear his side of the story, but so far he has refused to answer. Kind of says it all in my view.

If the information in this article checks out, we will definately know three things:
    1. Burris is not fit for the office to which he has been appointed,
    2. In addition to being of questionable moral and legal standing, the Illinois Governor can't even perform a decent background check, and
    3. none of this has any proven connection to President-elect Obama.

It is a shame that a majority of the citizens of Illinois must me associated with its government. There was a saying once, not heard much anymore, that "cream will float to the top." Right now it seems to be more appropriate to refer to a sewer and confirm that "apparently s*** also floats to the top", especially in Illinois government.

Kissably, the only ones pulling the race card are the media. They are the ones saying that this could possibly be a ploy. Show me where it says that Blagojevich and Burris are claiming race. Burris is demanding to be seated because he was LEGALLY appointed to the Senate seat. If it isn't so then someone has to prove it...

I'd like to know what happened to the "DuPage County sheriff's lieutenant" that perjured himself in the earlier trials? Oh yes, this is Chicago-style politics. He probably got promoted.

    • Posted By: lawguy47 @ 01/03/2009 12:59:13 AM

In the aftermath of the Cruz trial, a special grand jury indicted four sheriff's deputies and three former prosecutors for their roles in the Cruz case. Charges included perjury and obstruction of justice. Although a DuPage County jury acquitted these men of those charges, the County later agreed to pay $3.5 million to settle the civil rights claims that Cruz, Hernandez, and Stephen Buckley (a third defendant who had been charged in the crime) had filed in federal court. http://www.law.northwestern.edu/wrongfulconvictions/exonerations/ilCruzSummary.html

Excuse me Carlos523 if he was exonerated then there would be NO NEED for a pardon. Exoneration would have wiped his slate clean in this matter. It didn't because if it had then the Government would have to admit they were wrong. By acquittal, they can simply say the evidence pointed in another direction and his 11 yrs still stand. ac???quit???tal

Everyone knows that Cruz AND Hernandez had nothing to do with that murder. The problem with this case is how the prosecutor's still to this day refuse to acknowledge the misdeeds of the DuPage officials. A dream? Come on, that had to know this was nonsense. It is a shame that those LIARS never had to answer for the almost 12 years STOLEN from those men...

  • Posted By: kissablysweetone @ 01/03/2009 12:46:10 AM

Oh but they (Burris and Blago) are using the race card now. Saying if he's not appointed it must be because he's African-American. I mean how much lower can you sink before you finally stand up and say I WAS WRONG! For either of them. As one person said, Burris has tried many times for the position and never attained that goal. Why would he assume now he's going to be sliding right into that Senate seat?? I wouldn't want a Senator who came in under such suspicious circumstances or who puts himself above everything else. He may not have had anything directly to do with Blago's troubles, but, he also knew by accepting this appointment he was dead in the water. If he didn't, he's stupider than a Senator should be. What ever his color, religion, sexual preference, kind of car he drives or where he eats his meals.

  • Posted By: carlos523 @ 01/03/2009 12:44:51 AM

Anyone who knows anything knows that Cruz WAS exonerated. The problem that persists is that no one in the prosecutor's office had the guts to admit that the officers and ;lawyers railroaded Cruz and Hernandez.

  • Posted By: kissablysweetone @ 01/03/2009 12:29:07 AM

REALITY CHECK: Cruz was acquitted, not exonerated. The acquittal was the only way for the government to save face in this situation. That's why the pardon was necessary. It still showed on his record the 11 plus years he served. .

  • Posted By: kissablysweetone @ 01/03/2009 12:25:36 AM

As was stated many times over the past few weeks, anything touched by Blagojevich is tainted. For him and Burris to have the audacity to believe he should be appointed blows my mind. I can't imagine with all that's been going on Burris could prove himself to be the right person. He's already showing cockiness and arrogance, DEMANDING to be seated, then saying well I am seated. Anyone can see anyone appointed by Blagojevich is going to sink from the stench of his office. I also believe that ANYONE arrested in a government position as high as Governor should immediately be removed from office. If they had enough to arrest them with, then even if they aren't guilty of this, there's enough impropriety that this person should be removed. People who are taking anything Blagojevich says or does now as serious needs to join him in the unemployment line. A blind man can see in Illinois, arrogance, cockiness and illegal activity seem to run the show. All the way.
