    This article is a harsh reality of what is going on in this country as I write. Though it is not fair to those paying their bills, bankruptcies & foreclosures are used by many who are drowning in debt including some all the way up in the food chain & for whatever reason it happened. If i remember correctly our current good ole government is still sending to IRAQ $10 Billion dollars of taxpayer money every month & NO ONE DOES A DARN thing about it. Our good ole government also allows bailout of Banks that rape the taxpayer thru this so called TARP program yet if you do not pay your mortgage to these same banks then they foreclose on you how can this be? & our treasury secretary H Paulson should be fired immediately no questions asked NOW that is JUSTICE. In spanish HP (the initials of henry paulson) & as he is so often called by latins, means he is an "SOB"

    Tell that to the US Congress that bailed out Citi Bank part of Citi group on a Sunday night while we all were sleeping so that no one could call and stop it.-17 billion for car employees that make 30 dollars an hour with great health ins.
    Michigan might be in bad shape but we in NC went under 15 years ago when Sick Willey Bill Clinton signed NAFTA and the World Trade Agreement and put our country into a hand basket to hell.
    Now that all these companies are failing because the world economy has hit a brick wall, Bush Bambi and others start bailing to the tune of 3 trillion dollars. The world economy sucks- people making 50 cents an hour taking American jobs and selling us the depression goods. Time to change our funny money into Monopoly money so everyone can play. Get out of jail free cards and 2000 dollars every time you pass GO. Bill Clinton sold us down the World Trade river and now the Democrats want to buy it back. If we survive until 2010 we need to fire all the Congressional crooks.

    It is too easy to spend money they don't have, go on vacation, go out whenever they like,enjoy a prohibitive standard of life, and thinking that with bankruptcy you solve your problems.OUR LORD SAVE US from these ignorants who think like that.

    Ok so try this one, you have lost every thing and there is no way to catch up with the bills that you have, and I mean everything. Now recovering what you have lost you have to figure out what is most important, repaying your bills or feeding and clothing your children, making sure that you can have food for your kids, able to pay child support and live your life .... OR struggle so hard that everyone suffers and kids hate you because they have missed out of meals, clothes, the basic necesseties. Nervous breakdowns hurt... I have had three in six years, and I am now on the road to recovery.. but that is neither her nor there. Trying to recover what I have lost there are sacrifices to be made. Maybe everyone should stop and think about the ones who have suffered because of things beyond their control and then realize that yes bankruptcy hurts all and yes it has been abused by others, but as in my situation, there are times where there are no other choices

    nice... don't take responsibility for what you have done.. don't work harder to pay back what you borrowed... just declare bankruptcy.. let someone else foot your bills... i cannot believe newsweek would support dribble like this article... when did newsweek become part of the "actively seeking to destroy america" group?

    America loves to be in debt. All I hear about from DC is we need to get the credit flowing. What we really need to do is change back to a saving country. Credit is what got us into this mess. Most people who don't have cc debt have money saved for rainy days. Be responsible for your actions. What we need are jobs. If you look at other countries many of them have multiple families living under the same roof (the kids never leave). It's where we're headed if we don't change our happy spending ways.

    Then Congress passes a Bankruptcy Reform Act written by the Credit Card company lawyers. They have no shame at all.
    And American way says: "don't do it.

    Well Citi bank Citi group helped write these new stupid BK laws and now the FEDS bail them out to the tune of 30 billion so they don't have to enjoy the laws they wrote.

    Back off JACK, I will be the first one in BK line if need be- Good enough for Citi group- good enough for me.

      ummm...ok, you win...your logic has out-stumped me. Soooo, the credit card companies wrote the bills that would obviously favor them?? Then they get bailed out...so then they don't have to 'enjoy the laws they've written'? So because they're irresponsible, you want to get in the BK line because they are? Am I missing something here? Lemmings Ho!!

    The fact that Americans put so much effort into avoiding bankruptcy is demonstrative of just how entrenched and pervasive the America petty capitalist false ideology truly is. Why should ordinary Americans feel such a sense of ethical obligation not to default on their financial agreements, when their corporate counterparts in these arrangements have no such decency or sense of social responsibility.
    The majority of credit card lenders - whose corporate offices are filled with predator-elites - have intentionally created contracts that are so convoluted, littered with unnecessary arcane verbiage and innumerable clauses, that consumers hardly know what they are getting into in the first place. Some of these creditors include provisions whereby the interest rate resets to some explosive figure if a consumer makes a late payment, not to the creditor, itself, but to a third-party financial institution.
    Furthermore, corporate monstrosities such as Citibank had no qualms in receiving a financial bailout, which was necessitated because of irresponsible over-leveraging and Citibank's resulting lack of liquidity.
    To even suggest that Americans should even have an inkling of remorse when it comes to employing what few legal protections they have available is laughable.

        When are people going to realize that a credit card purchase is a short term loan ? You have PROMISED to pay it back. Everyone else has promised to pay their's back also. So why do you think YOU can walk away from it? The rst of us will be charged more in the future for your irresponsible behavior. You didnt NEED that night out....that last big screen TV...that stereo system that you are sio proud of. You couldnt AFFORD it,,,,please dont make the rest of us pay. And, as for driving up the home prices. You knew what you were getting yourself in for. You drove up the price for a lot odf responsible home buyers...and now what ? "I was only kidding??". Sorry...it doesnt work. Pay up

        Let'snot forget that people who file Bk tend to fall into 2 categories. 1. Those who spend with no thoughts for tmorrow, no $ bank, waaay too much debt etc. when something goes wrong it is blamed on the credit card co and thier huge interest and fees or the mortgage co. and their subprime mortgages. My question is why is it everyone elses' fault? Did you not get contracts that spelled out the terms? Did you agree to those terms? Did someone force you to buy these things or agree to the terms? I am guessing probably not. It is no one's responsbility to look out for you but you. If you fo not plan for hard times by keeping $ in the bank and keeping your debt low and securing the very best deal on the debt you do have admit your mistkaes do not blame it on others. The people I have compassion for are those who do all those things the "right" things and due to extended illness, a long period of unemployment or their investments being severly depleted by losses in the markets see all their hard work and diligent planning go up in smoke and are left with no other options. I am tired of people thinking because someone offered to loan them money and they took it without thinking that somehow they have been cheated when it doesn't work out. No one ever promised you endless employment and rising housing prices bad things happen to good people so plan for the worst and hope for the best don't spend for the best and whine during the worst.

      Very well said. Clearly those that are so judgemental have no clue what it's like. Having paid my bills all my life (on time) and having had a credit score of 825, I would NEVER have thought I would be in the position to have to file for bankruptcy. But the real estate market forced me into it. My pay went down by 70% and I did everything I could to work with my creditors. They don't give a flying flip about working with me. They break every law and get away with it. So I filed because I was left with no other choice. I'm a well educated single mother who never took a dime of child support and alwys paid my bills on time. I was raised to pay my bills on time. It's just a matter of honor, but I'm here to tell you that if you need to take that route.... Take it and move on. And to those of you that think that you
      know everything, beware. You may some day be in this position when you least expect it. You never know how your life will turn out. It's not easy for anyone right now. Keep the faith.

    miracles42 and everyone else out there, I know that I've been considering it as well. Why should I feel guilty or ashamed to do it. I pay all my bills on time, but was out of work and had to rely on my credit to pay for food, and everyday living expenses. I tried to negotiate payments and whatnot, and hear sorry about your luck, kick rocks, or simply f-you pay me. Everyone else is asking for handouts, and walk away from their debt. We've all seen it, so anyone out there judging take a look at yourself first. I'm sure if it isn't debt, there's something that people could pass judgment about you too.

    Nice way to tackle a difficult subject. We stopped jailing debtors in the country centuries ago. Sometimes things don't go our way, but we are always responsible (or at fault if you will). Having no debt allows for significant savings and provides a fallback for the inevitable bumps and blind curves we find ourselves on. America is a nation of optimists so we overborrow and overspend on the assumption that tomorrow will always be brighter than today. Risky behavior sure, but more often than not it all works out. That is until it doesn't. The point of this article is to recognize the road signs and take the bankruptcy offramp before crashing into the wall at full speed instead of after. After, you are most likely judgement proof and a bankruptcy filing is just a way to get the phones to stop ringing and get on with your life.

    This opinion seems half right and half silly. You CAN file chapter 7 and keep your house! Why should you pay to live in an apartment where the rent is surely to increase yearly? You shouldn't. File bankruptcy, and reaffirm your house and car as long as they are not ridiculous. You will need somewhere to live and a way to get to work! This way you KNOW what your housing bill will be like and you will truely be able to have a "fresh start" to rebuild your life.

    Does anyone think about the people and the situations in their lives that have caused this? Absolutely, there are people that take advantage of the systems and programs, but there are also peoplo who have serious things that happen beyond their control and those are the people that need help.
    After fighting the fight and trying different things....I am unfortunately and sad to say that bankruptcy is my final destination.
    I was diagnosed with an uncurable disease, that caused my need to make a change in occupations... a huge pay cut...
    Now I recently have been through two lay offs....so no job....and guess what there aren't many out there..
    I was left with the full house/life responsibility by the person that I thought would help me through our debt....marriage. in this country, not an option for me so my bills are not split by two but two people created them nor will they share my pain and embarassment of bankruptcy and foreclosure.
    I have gone through my 401k and used avery asset I had. I have used every friend and family member I can to help me.....but I can't continue to go down this road with no end in sight...
    My health is the most imprtant thing to me....
    so I ask was/is this all my fault???
    I own my poor decisions, but I never expected my life to end up this way.....all of my mistakes and decisions aside, I know I would not be where I am now if I hadn't gotten sick.... I would be on the up and up not the down and out. So before you judge, be grateful for what and who you have and know that it can all change in a day.

      IYou should not feel ashamed. The Credit Card companies have everyone brainwashed. Here are a few "losers" that went bankrupt. Walt Disney, Mark Twain, Ulysses S. Grant. to name a few. The CC comanies have brainwashed everyone. Meanwhile corporate America (including the very companies which point the fingers) have no problem with discharging their creditors in BK. IThank you for sharing your story. You are not to blame, and in fact, the only mistake you made was not filing sooner before your IRA was liquidated. God bless you.

    i have been making payments on all of my credit card bills, until i decided that i needed to try to negotiate my billls. So i tried on my own and they say nothing was behind than i got laid off from work and went with credit solutions to help me. they told me to put money into an account so that they would have access to help me out with me making payments to them they never took care of nothing and now i'm still laid off with all of the creditors calling me. Credit solutions said i can't help you i'm not an attorney, but how much money do you have save so we could get some more of your money to do nothing. watch out for creditors that claim they could help you when they do nothing but take your money and keep it.

    I keep reading post to the affectof "Iquite using my credit cards and have been paying on them for 2 yrs and was doing fine until I lost my job/became disabled...dont charge anything that you cant pay for within 30 days!!! Credit cards are for MONTHLY consolidation of expenses not financing purchases....only finance your house and only that after you put at LEAST 20% down!!!!!!!!!!!!! Then when you have hardship you will only have a house payment

    What a sad commentary for our culture when publications such as Newsweek support bankruptcy. To so easily describe how to assign ones debts to other taxpayers is the basis of our existing problems, no personal responsibility.

    What a timely article. Excellent. It is truly a difficult decision. I got sick after having my twins in 2001 and each year we became increasingly financially strapped. My husband wanted to protect his credit rating so I cleaned out my retirement savings to negotiate with the credit card companies. All settled except Bank of America who are threatening a lien on my home. My husband left the children and I in April of 2008. So here I am, without retirement savings, without a husband, still facing bankruptcy. My house has no equity. I only wish I would have bitten the bullet and filed bankruptcy before this. I never thought I would be in this posiition..ever. I don't judge anyone, anymore. Things happen and the best laid plans fail. Good luck to anyone contemplating the huge step of bankruptcy.

      Don't feel like you failed. Some of these posts are not realistic. How could anyone make plans for what you have been through? We live in different time then a generation ago.
