    I am totally in agreement for not jailing a person that is not found guilty of a crime.
    HOWEVER- I also think that each case is based on it's own merits.
    Madoff is responsible for suicides, bankrupt hard working people, and greed that is the epitome of our stupidity when it comes to our economic downfall.
    That poor man deserves only the best in our pollyanna based society.
    Get a grip!

    It is interesting how Newsweek runs to the defense of a rich white Jewish establishment financial guy who, by his own admission, is guilty of bilking billions out of people through a Ponzi scheme. Because much of this money came from charitable foundations, it will result in the deaths of hundreds, if not thousands, and diminished quality of life for thousands, if not millions. I am as certain as I can be that Mr. Gimein would not have wasted this many column-inches on a poor black man who passed a bad check to feed his family but could not raise $500 bail.

    Public hanging would be a much more appropriate punishment for Bernie Madoff. There is no sensible reason to let anyone stay free on bail, or under house arrest, when thet person has demonstrated that they will disregard the orders of the court and will continue to commit crimes while free. Every asset of Bernie Maddof and every asset that had been transferred to another just prior to his arrest should have been frozen immediately. All overseas assets, including his homes and account abroad should have been blocked, his passport blocked, his name on the no-fly list, and he should be held in jail pending trial with only monitored visits alllowed.

    Going to his defense is absurd when the felon has already admitted his crime, gets out on bail, and confounds the courts and continues to commit felonies while free. Enough, already, Newsweek. There are innocent people deserving of your editorial attention. Bernie Maddof is not one of them.

    While i do agree in theory with your analysis it seems somewhat silly to start this with Bernie Madoff.

    Let Me guess.....Mr. Gimein voted for Obama for change, he thinks....... the government should pay to keep wild horses free......terrorists at Gitmo should have access to US legal system........ the government should provide healthcare...... we should spread the wealth........ humans can effect climate change ......on and on......

    I salute the Newsweek on the stand they have taken.If there is no danger of flight,no possibility to re offend and no possibility to tamper with witnesses/obstruct justice,the Madoff should remain on bail tlii he is convicted.To send him to jail just because emotions are running high in the community, is a violation of the fundamental principles of justice.Let a Court find him guilty and convict him.Then jail is the right place for him to be.Otherwise we will wind up opening the floodgates and people will be held in jail pending trial for the simplest of criminal offences.Imagine being locked up pending a trial and the being found not guilty.That would be a real travesty of justice.

    It is hard to believe that Madoff does not have a substantial nest egg somewhere offshore. With such resources, it is also hard to think he will not try to escape at some point. Anyone used to a life of luxury for so long will not go quietly to jail . It is far easier to escape from justice from the outside than from the inside. Ankle bracelets are far from foolproof, especially for someone with enough money to hire the best lockpickers in the business. Madoff will run eventually as many rich defendants have run in the past. After he gets away, I wonder how much concern for his rights and for the rights of other

    Ok bail He could not get 4 people in the world to co-sign a bail. So he gets an ankle bracelet & guards? So he can stay home? In his million dollas CAGE? Are you serious? I've never been in jail, But I bet if I was arrested for anything & I couldn't make bail or get a co-signer I'd be sitting in a cell . AM I right? SO why isn't he? He stopped talking? Lock him up in rykers I bet he'll talk a lot to get out. The writer of this article is asinine. Can't believe that he actually got it published. Journalist integrity?Pffft.....

    It's not a matter of justice. Madoff is a bona fide flight risk. There is already one convicted white-collar criminal who surrendered his passport and was still able to escape the United States and flee to Isreal, where he continues to live free. Madoff has the resources and connections to do the same. He has also clearly shown his disrespect for the law and his intention to circumvent the law wherever possible.

In the real world if you can't get a co-signer or have bail money you have to stay in jail! Put him in jail. He belongs there. Bet if you lock him up in rykers.     once again, pure and simple. madoff violated his terms and conditions of bail...that in its itself are against the law and has penalties. he again, selfiishly gave his assets to family members, to save for him later...lock him up and throw the key away..

    Point of the article aside, for all of the lives adversely affected by this man give him life in jail without chance for parole.
    If anyone decides to commit suicide because of what Madoff has done to them financially; give him the death penalty.

    No. All three of the above comments are wrong... you are all missing the point. Consitutionally you have a right to a fair trial before you are convicted. The preservation of that right (YOUR RIGHTS) is what the article is arguing. Yes we all know that he admitted, but if the strategy is to just jail everyone that is accused, then throw out he Constitution and lets go the way of the middle east as jarcher1 stated and just jail everyone and take them out in the morning for proper cut their throats... Don't give up the rights because one person felt it was his right to walk without a ledge...

    No wonder the country is in such a mess - seems that almost all commentators have really lost their moral compass. I assume they would also all argue for justified torture - this hard right "non-think" is exactly why the US is the tragic laughing stock it is today internationally and exactly why Bush and his cronies were allowed to do the incredible damage they now unarguably did.

    The argument is NOT about Madoff, but about justice for those too poor to post bail and who consequently go to jail - guilty or not. That is where the potential for incredible injustice sits. No one would argue that a Judge should appropriately weigh the risk to the community before allowing reasonable bail and equally no one should ague against a judge setting reasonable bail for those who pose no risk to the community.

    If America is to rightfully regain it status as the leader of the free world it needs to take the moral high road once again and ensure that we don't torture anyone ever for whatever reason, that we don't send people to jail before they're found guilty, that we don't start wars on false information, that we don't support despots for political expedience, that we don't allow a health care system to fail those in need, that we don't let large Corporations and Institutions off the hook for their fiscal misdeeds especially when many of them pay next to no tax, that we look after our wounded soldiers with the best we have - even if the war we sent them to was wrong to begin with, that we deport all illegals who commit a crime (any crime other than being here) and that we don't demonize those illegals who work hard, pay taxes and contribute to the community, that we stop giving money to other countries other than for pure humanitarian purposes until we have solved our own chronic humanitarian issues of poverty and homelessness...and the list could go on....

    There's a lot to be proud of and sadly a lot to be ashamed of - this article makes a simple point - equal justice for all - rich or poor - a constitutional right and just the right thing to do - don't get lost in the financial enormity of Madoff's misdeeds - think more of the poor innocent guy whose life is ruined before he even gets to jail - like so many other things it's time for America to show it once again knows the right thing to do.

      Excellent, a guy who really can read and understand the main points of an article. Wingnuts are always blubbering on about such Constitutional protections as those to keep and bear bazooka's and the freedom to libel your political opponent, but by and large they want to nullify protections for those charged with a crime. Anything to make it easier for prosecutor's to get a conviction. A really dangerous and stupid position when anyone can be charged with a crime on the whim of law enforcement/prosecutors/politicians. Innocent people don't get charged with crimes? Dream on.

Tthe article, if you read the title, is focused specifically about a rich guy who ruined the lifes of many people, and who has the assets and the connections to leave the country to avoid prosecution. He has also clearly demonstrated his willingness to continue to defraud the public by attempting to hide personal assets that could be used to give restitution to those he defrauded.

      Don't trash America. If this were a country in the middle east, eastern europe or maybe even china, corrupt authorities (also read as the rich ruling class) would take Bernie out back and slit his throat or put a bullet in his head, but only after breaking his knee caps and putting bamboo slivers under his nails to figure out where he hid the rest of his assets.

    The purpose of bail is to allow the suspect to be free as a law abiding citizen. When Madoff sent his assets out of reach he was clearly depriving those damaged of potential restitution. Since he does not understand the nature of his crime, despite his own admissions, he deserves to be in jail, When you are free on bail you are free to obey the law, not thumb your nose at it.
