    Guitmo is located outside the U.S. for a reason. If the prison is not in the U.S. , then it is not subject to U.S. Laws.
    After 911 , The U.S. offered cash rewards to Warlords in Afghanistan to turn in terroists . Some of the people turned in were innocent, because the Warlords just wanted the cash . So we wound up with a population at Gitmo of some innocent people , some dangerous people , and we had no idea of who's who. I do know if you strap a car battery to the testacles of anyone , they will admit to just about anything.

    For the Bush administration to disingenuously contrive legal loopholes where there were none in order to provide domestic political cover to torture only demonstrates that they understood that what they were doing was illegal and that they therefore willfully violated the law.

    Their use of torture violated our domestic laws against torture, the Geneva Conventions, and the UN Convention Against Torture. It cannot be sloughed off as merely a "policy difference" or as a different interpretation of what is ethical or humane; it was literally a criminal act under and against our Constitution. Protecting the Constitution demands investigating the Bush administration's use of torture, among a long list of other prima facie crimes.

    The pursuit of justice is always about balancing the scales of the past with the present for the future and not about just letting bygones be bygones or trivializing past crimes to make them appear less than they were. If we are to be a nation of laws, not men, in the future, we must prosecute the past crimes of men in the present, and that has to apply to all men, however powerful, powerless, rich, or poor they might be. Otherwise the claim that we are a nation of laws, not men, is mere sanctimonious blather.

      Lets just be really really nice and terrorists will like us someday. You liberal`s are so naieve! Terrorist`s want to DESTROY that same constitution you say Bush violated. And why would they want to destroy the constitution you wonder? Its very simple. So simple that I think you would understand it. BECAUSE ITS NOT BASED ON ISLAMIC LAW Duh!!!!

    I will miss President George W. Bush and am afraid for what is to come. I believe he will go down as one of the top president and time will tell.
    I will give Nobama a chance, but his past performances are not shedding a bright light. I fear we will revert back to the Clinton years and maybe worse were our country will be a target. I have no problem with their interrogation practices because it saved lives. You libs forget that hind sight is 20/20 and I would rather be safe than sorry. We would probably be having the same argument if he did nothing but I regress. Maybe we could charge Clinton for not doing anything and putting the citizens in harms way.
    And as for the non-American, America and the Bush Administration have probably done more good for your country than any of your so called allies. What do you base your accusation on?

    aight. it was small provocation about guantanamo. i think as it is nowaday problem it's worth of investigation. that's all. But i still can't get how come that governement is not telling us everything. Just check Erik Gandini & Tarik Saleh movie about it. That's all for me this is obvious. Till 209 guantanamo problem was connected with cowboy bush and co. same as 9/11. maybe not bush as well, couse he is...whatever but those people who are behind him like NSA.

    I just can not understand the idea of as ther's said "witch hunting" WTF? it was many years ago guys. It's 2009 and contry should look forward, not clean old mess like guantanamo or even fckn nineeleven. governement should take care for people who stopped to believe in that imaginary american dream. That fckn buracrasy and governement hypocrisy kills natural human abillity to be ambitious. People who can do something they even can't finish a school. They are stupid? Look at those kids from MTV and even..wow gosh look there at that XX campus...HOW FCKN COME that students in Europe don't have time to party because of studies?     We as a country must investigate the civil rights and torture abuses made by the Bush administration. It is required by law and it is a moral imperative. Since Cheney and others have admitted torture, this torture is now on our plate as a nation. We should not rationalize away that fact. It is what it is. If we are to remain a nation that stands for our constitution, stands for our treaties and rule of law, we must act when these are abused. The Obama election means little if we bow to this hypocracy. Yes, we are in crisis that changes priorities, but it doesn't change the game or our ethics. We can walk and chew gum at the same time. At the minimum, an investigative commission should be set up to investigate the truth and make it public. This should be published even bigger than the 9/11 report. No underlings should be pursued like a witch hunt, but all should be embraced to determine the truth. The truth will repair the stains and tears in our constitution, laws, and treaties. Priority should be given to determine the truth and responsibility regarding decisions of power and the power of abuse by Bush, Cheney and others. At a minimum this should be made public, freely published, and the stains placed on these abusers for all time. These abusers of our constitution should be tarred and feathered by truth and the public commons. That is better justice than taking them through a judicial court.

    Outgoing CIA Director Michael Hayden claimed in interviews and speeches earlier this week that President-elect Barack Obama promised him personally last month that he would not launch an investigation into the agency???s interrogation practices.

    But when asked on Friday to respond Hayden???s statements, two high-level aides on Obama???s National Security transition team who were privy to details of Hayden and Obama???s briefings disputed the CIA chief???s comments, saying that Obama did not make any such assurances to Hayden or anyone else in the Bush administration about not investigating interrogation practices. The aides requested anonymity because they said they were not cleared to speak publicly.

    While I do believe that Obama needs to focus on moving forward, I believe that we can only move forward by being honest. If the Bush administration is guilty of aduses of power including torture, then they need to be held accountable, just like any other citizen of the United States. There should be equality under the law even if the one accused is in political power, especially if he or she is in power politically. IIt would also send a message to the rest of the world that things are changing, and that we as a nation are working towards real equality and justice.

    While I agree that Obama has to move forward at this time, I also believe that the Bush administration needs to be held responsible for their actions, just like anyone else. Furthermore, I think it would do a lot to rebuild our standing in the world community if we investigated these alligations; no more and no less than any other US citizen.

    I'm not sure about the interrogation techniques I think we must always be ethical and humane, and set that example for other nations. However, any violations against the principles in our Constitution, such as illegal wiretaps, or certainly the interrogation techniques if they were used against US citizens, absolutely must be prosecuted. Doing nothing would sustain permanent damage to our Constitution. We must send a message to every state, every citizen, every court of law, and every nation that Americans take their Constitution seriously. Without the freedoms guaranteed in our Constitution there is nothing special about being an American. It is essential that the US Constitution be protected.

    Why not waterboard Bush and Cheney, let's see if they think it's torture! If the US doesn't prosecute them, other nations will. They have been found guilty of war crimes, lying to and spying on Americans. How they got away with this cr*p I haven't a clue.
    Now they have ruined the world's economy, they think they can crawl back in their holes, nope, cause karma is a bi*ch.
    You get what you deserve, and they will deserve exactly what they get!

    Why not take this issue out of the political realm and leave these decisions to the career prosecutors in the Justice Department? We were quite critical when politicians in the Bush administration exerted pressure on career prosecutors, and we should be equally concerned if similar political influences are allowed to control the pursuit of justice now.

    that's funny, i don't remember electing anyway at the CIA to make presidential and constitutional decisions for me...oh well, they probably know best and i should just go shopping
