    ???The right of private judgment has never yet been so exalted above the powers and the compulsion of the agencies of government??? [as to justify striking down as unconstitutional a state law].

    Justice Frankfurter's dissent makes for very interesting reading. That said, Mr Lieberman is not Felix Frankfurter, much less is he Benjamin Cardozo. There can be laws against freedom. There cannot, in a democracy, be laws agains freedom of thought. Anyone who argues otherwise is misinformed and misguided.

    The interviewer writes that the pledge of allegiance is "not mandatory in America". In fact the Supreme Court ruled in 1943, in the middle of World War II, that it was unconstitutional to require it. This question has been handled again recently, but look what Justice Jackson wrote for the majority:???

    "If there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion or force citizens to confess by word or act their faith therein."
