    Frankly I think the Red Cross has no business meddling in Foreign Affairs unless it involves a U.S. Citizen. The Red Cross is an American organization for the benefit of AMERICAN CITIZENS. They should have no input regarding foreign detainees of any origin. Maybe that's why Red Cross is financially strapped. GET OUT OF GOVERNMENT AFFAIRS RED CROSS..THAT'S STATE DEPARTMENT BUSINESS

    the suspects should of been given away a long time ago and the two authors should charged with giving aid and comfort to the enemy. in case no one has figured it out the terrorists have no uniforms and do not represent any country so they are not entitled to red cross protection. another reason i do not donate to the red cross. also another reason not to renew my subscription to newsweek.

    Yes our enemies commit atrocities against us without second thought - justifying it even in the name of religion (like our own right wing fundamentalists by the way). That makes it right for us to do? How would we be any different, any better, how would we be America if we did the same? Isn't that the point? That we're not terrorists, that we're fighting terrorism, that we're fighting for something, in whatever name, that's better? I for one want to be proud of America and hold ourselves to the standards we've always believed in, though we may have failed in the aftermath of 9/11. Thank goodness we're righting ourselves now, maybe the world will start to believe in us again. Maybe we can start leading again - instead of following the terrorists down the barbarian way.

    Once we hand off these detainees to their countries of origin why does anyone suppose that, somehow, we remain responsible for those detainees? They're no longer in our custody. I for one have grown quite tired of these bleeding-heart lefties who feign concern for those who intend our destruction. What our countrymen on the left simply do not (and apparently, cannot) grasp is that all of their heady high-mindedness and smug self-righteousness only makes them FEEL safer and FEEL better. It does not MAKE them safer. What makes them safer is the extraction of actionable intelligence from detainees--intelligence that helps foil plans, plots, and attacks. That's what makes us all safer, and I dare say, keeps some of these lefties alive. But they're too busy having a lovefest with our enemies to see that. Frankly, what they're doing borders on treason.

    Guantanamo Rights

    The decision by the US Supreme Court was long over-due, and even now, it must be applied to all. AS we know, the US Regime has "rendited" prisoners to their colonial courts (Afghanistan etc) to make them "disppear". They too have a right to be either heard, or publicly apologized to - not forgotten in some far away dungeons.

    This decision, as it came now, is absolutely necessary to save even the image of a judiciary based on human rights and dignity. That Mr. Scalia disagrees with it again and believes it will cost more American lives (why only American lives - are they special?) is sad and worrying enough, as Guantanamo itself has already caused more deaths than even the 9/11 attack.

    What has been overlooked so far, however, is that this ruling must also apply to all those prisoners who were removed from Guantanamo - whether they were extradicted to prisons in their home countries (like Australian Hicks, under coerced "confession") or to security sets which released them - OR, and that is presumably the largest group, as they comprise, at least 140 Afghanis, who were sent to kangaroo courts in their countries and made disappear from sight after mini-pseudo-trials based on "evidence" not even the Guantanamo tribunals could admit nor accept.

    These "renditions" which only served as cover up and fig-leaf to long-term and continued unjustified incarceration must be reversed and the Bush administration - sorry: Regime- be forced to either show charges AND PROVE THEM! Or offer substantial compensation for wrongful and illegal detention.

    Such righting of legal and moral wrongs presupposes, of course, that ???estos desparicidos??? are still alive. We know, after all, that this was not the case with almost all of those who disappeared in the hands of government forces trained in interrogation and torture by the CIA in the, now defunct, infamous ???Academy of the Americas??? in Panama, which was so disgusting that US Congressmen who demanded to see it were arrested and deported when they turned up on the doorstep. And President Reagan???s friend in Santiago de Chile (viz 9/11 in 1973!) had his ways of ???rendition??? by dropping netloads of disappearing people from helicopters out at sea. Have Bush & Co learnt from such allied techniques? As long as we do not know the opposite ??? with evidence provided ??? we must presume the worst.

    The question of personal legal responsibility before an International Court (say: The Hague) should be considered after the persons involved in the setting up of Guantanamo and other prisons camps of doubtful repute (Abu Ghraib, Bagran) left their offices and the immunity they enjoyed therein. That is: Neither Messrs. Bush nor Cheney, nor Ms. Rice, and many others should be able to travel to any of those countries which ratified their cooperation with the International Court, without fearing arrest and trial for Crimes against Humanity.

    You know I'm not some flag waving "hang 'em high" type. I think the U.S. is above torture. But if these guys DID plan/execute the 9/11 attacks, I don't care how many times they were waterboarded. You want to talk about human rights? How about the rights of the 3,000 of my countrymen and women that were taken that day? If I do have an aggressive and violent side; Al Qaeda are pros at bringing it out.

    How can the US stand up as the leader of the free world with regard to human rights when it allows torture, does not cooperate with the Red Cross, ignores the Geneva Convention, and sends prisoners to countries with abysmal records on human rights. . The Bush administration did untold damage and aided and justified every tin pot dictatorship which uses torture. They (the dictators)argue the US is no different than we are. Don't ever wave your constitution in my face again because as far as I am concerned you tore it up and threw it away a long time ago. Mr Obama changing the rules does not remove the damage. Also not holding those responsible culpable hardly strenghtens your hand when you want to bring others to book for the same crimes. How could yhou redefine torture as not torture. It opens the flood gates for every beast to redefine what they're doing. You really should see how people perceive you around the world over this issue. At best it's extreme disappointment and those are your friends.. You know the worrying thing is the status enemy combatants is the excuse the communists used to use when they wanted to ignore the Geneva Convention. Maybe with the fall of the soviets you're adopting some of their practices. Another one was stripping people of their ctiizenship. Is America going Communist?

      Please post an opinion on your position on the terrorists who be-head humans...I never see an opinion about these people and what they do to humanity...perhaps we should just let them do what they want...maybe you will be next.I am sure that the many people that have been be-headed would trade that treatment any day for waterboaarding. Ironically they were ordinary people that had not tried to kill anyone and they lost their life. By the way because of your position on interrogation not tourture did you notice that the military stopped trying to capture the terrorists and instead just sent a missle into their compounts...that is the cause and effect of your position...we lost valuable intelligence information but were not subject to ridicule for interrogating not torturing these poor innocent pure of heart and mind terrorists.

    Ive never been to NY nor do I know anyone who died so inocently on 9/11. So John Sifton where was the human rights to the civilians so tradgically killed on that darkened day? These criminals caught were waiting in line to come over here to kill you and me next. So lets have it your way and give them a chance to do it. The bleeding hearts make me sick to my stomache to want to defend these ignorant criminals and not speak out for the innocent Americans who died on that day. I would rather die on a batttlefield with a gun in my hand instead of in an office with a ball poit pen.

And to all you human rights activists that think that terrorists should be treated better, I say get a life, find something productive to do with your time. These people don't care about you, your families or anyone else in who is American. What about the human rights of all the victims of 911? What about the 911 victims families? Do you think the terrorists give a damn about any of those people? NO, THEY DON'T!!! I say do what you have to do to get the information that is needed to prevent any other Americans from being harmed from terrorists. They have no rights...they gave them up when they decided that they wanted to attack us...Find something else to stand for...How about standing up for the rights of all of the Americans that have lost thier lives because of the terrorsts.

      I'd explain to you that the concept of due process isn't a "favor" granted to criminals, but a method by which to determine whether or not someone has actually committed a crime, but judging by the neanderthal post above, you wouldn't understand the distinction, anyway.

      You are a disgrace to this nation. You should consider moving to Red China...their legal system seems more appropriate to your taste.

        You sir, need a reality check. We are at war...this isn't about someone who got arrested for breaking the law. This is about taking prisoners from the war and extracting useful information that could be used to save more American lives. I guess you forgot that they (the terrorists) don't care about our country or our people. I guess you don't care about all the innocent people that they have killed or the families of thier victims. I guess you are okay with the way they treat our troops or the way they kidnap non military civilians and behead them. Maybe if it was someone in your family that was killed because of thier actions you might feel a little different...maybe not, who knows. All I know is that the terrorists would kill you too if given the chance. You should think about our country and all the people that have lost there lives because of the terrorists that you feel we should pamper...maybe feed tham steak and lobster every other day.

        Let me ask you this...How would you treat the terrorists if it was all up to you? What if your family died during the attack on 911? What if it was someone in your family that was in Iraq trying to make aliving for thier family that had thier head cut off because they were American? What if it was someone in your family that paid the ultimate price so that you can sit where ever you are and type on your computer and voice your opinion.

        I believe that we as US citizens have a right to due process...I do not feel the same about terrorists. They are terrorists!!! They wiould kill you and your family if given the chance.

WE NEED TO SET UP A CYBERSECURITY ARMY THAT WILL SECURE OUR INSTITUTIONS AND KEEP "BORDER WATCH". CYBERSECURITY BREACHES CAN SHUT DOWN OUR DEFENSES AND LEAVE US VERY VUNERABLE. THE HEAD OF THIS ARMY must assign a division dedicated to penetrating our own defenses it is the only way we will get better.

    "Some confusion" may be evident...certainly there is confusion, perhaps much of it intentional...but don't blame the Red Cross. Its not easy reporting on events a powerful government is doing its best to obfuscate and distort... as the U.S. government...aspiring to be a security state... seemed to do about lots of things, while Bush and Cheney were running things. The U.S government has the facts; that it refuses to release them justifies an inference that the facts don't favor the interests of those who decide to keep the facts secret...and likely, those who decided to carry out the effort to suppress terrorism in this way in the first place.

      I am not convinced. As we see the Red Cross has been gulled by jihadist propaganda before. The too,trumping up ''torture''charges is an actual al Qaeda tactic,used by prisoners that were a portion of,or in league with this group. I will neither damn Bush nor praise Red Cross at this time. More is needed, and not from the media-savvy jihadists,who know their American news sources.

          As you may read from an earlier post, I have challenged Isikoff to also force the production of the Waco Branch Davidian siege documents by the then-Clinton Justice Dept and administration.Thus ''fair'' would also include possible prosecutions for torture on not merely the portion of former Bush administration figures,but those from the Clinton administration as well. ''Danforth-style'' congressional whitewashes will not cut it. Lets have all of the documents [including the over 22,000 from Waco of which not one page has been released despite FOIA demand for nearly 15 years,hence no authoritative histories on the subject], out there.

    I hope readers won't be confused by the childish, swaggering he-man comments made in support of torture. These comments come from a small minority group of Bush supporters that are on the very fringe of the Republican party. Thankfully even most of the people who voted for Bush aren't with him on torture and those folks need to start speaking up or they risk being forever associated with the cowardly thugs who are posting here.

      Pmorlan, you should not broad brush people like that. That point is continually being made that the former administration somehow violated the US Constitution by "harsh interrogation". No one credible has advocated torture. I have spoken to many of our service people who adamantly claim that they train for being tortured in more harsh ways than our interrogators have done with the terrorist/jihadists.

      In fact, the constitition confers no rights to Pirates and Terrorists, commonly known as non-uniformed enemy combatants. The geneva convention confers rights only to those who are captured as uniformed soldiers and servicemen. While your kind wish to confer the sacred rights of a US citizen on these people, you at the same time advocate abridging the rights of US citizens.

      I, for one, think it is the height of stupidity to release these "enemy combatants" while we remain at war. We know that we have recaptured them on the field of combat and sometimes have recovered their body parts from suicide bombings. Your sanctimony is folly. If they remain in Gitmo, or some other hold facility until all hostilities have ceased, there is nothing illegal or wrong with that. It has never been the policy of this government to "torture". Torture is a sad state of mind for someone who wishes only to cause suffering. Our interrogators have only been moved with the intent to obtain information.

      As soon as there is no valid reason to interrogate, then they cease using the resources. After that, there is no valid reason these captured enemy combatants should not be held, on a life sentence if necessary, until all hostilities cease. We would never have released Nazis during the war, nor Imperial Japanese troops. It would have been unthinkable.

      Only a sanctimonious fool imagines that we should release these blood thirsty pirates until after the war is over and they can be released to the custody of whatever stable republic is established where they originate. If you had any sense, you would understand that. But, somehow you think that you should blame your country and coddle terrorists. Your sense of justice and freedom is warped. These are not hippies carrying flower signs. they are committed to your destruction. they will continue until they complete their goal. They must never be released to freedom again. A military tribunal in the USA is sufficient to determine whether they have captured a true enemy combatant or some innocent by-stander.

        Certainly it does. Try reading amendments V and VI. It says "no person", not "no citizen". Everyone in American custody has the right to a trial (even if it's a tribunal and then - upon conviction - a firing squad, and no person in American custody or jurisdiction may be tortured, due to amendment VIII and article VI.

        And broadbrushing is not out of line. If you support terrorism, you are no American; you are a barbarian.

Indeed,the new Obama administration desires to retain detainee ''state secrets'', ''wiretapping'', ''rendition'' [ ''Extraordinary Rendition'' was a word coined by then-Clinton NSA chief Richard Clarke,who is no hero], and other Bush -era devices seen as odious by those critics of Bush. Indeed, KOS now floats a new moniker for the president:
