    I believe Troy Davis is innocent.

    The American legal system was written to protect white people, and not Black people, the police do not up -hold the law, they are often found in-breach of the law where Blacks are concerned. The Rodney King is an example of that. The American legal system is not based on the LAW but based on Racism.

    America is the only country in the world that has such a Policy, a legal system based on Racism more than up-holding the law.
    Even the electoral system is based on RACE, Obama was put into office to tell Blacks that things have changed but changed for who?.

    America has a policy that they are the first to speak out about other countries for irregularities in the elections of other countries, but yet George Bush could steal an election in 2004.

    The only country in the world, who tries to prevent Blacks from VOTING, using any means they can find including accusing the electorate of having a criminal record to prevent them voting. Many Blacks have turned up to vote and accused, though have never had a criminal record.

    If the American model was followed there would be no Democracy in the world, The UK has a Government that no one in the RELM elected, and speak on the world stage as if he has a mandate, when in reality the British public can't wait to get rid of Gorgon Brown. These things makes a mockery of what we call Democracy.

    While Gordon Brown speaks out about Iran, and Zimbabwe, he has no Mandate in the UK. Which makes the system a JOKE.

      Daphne, I have to say that it is people like you who make racism alive and well in this world. Please tell me where in our legal system it points to accusing the black man but not the white man. According to the Bureau of Justice, statistically speaking, "In 2005, offending rates for blacks were more than 7 times higher than the rates for whites ". With this statistic alone wouldnt that tell you that more blacks would be arrested than whites since the offending rate is higher. I do not see how this is the system intentionally working against a specific racial group.

      As for your claim that the US tries to stop blacks from voting, please back that up with facts instead of opinion. For instance; FACT: According to U.S Census Bureau's 2006 voting and Registration Report only 48% of those able to vote actually voted. Of that 48% roughly 96 million people, Non Hispanic Whites had a 52% voter turnout, Blacks had a 41% turnout and Hispanic and Asians had a 32% Turnout. So, one again I think the statistics speak for themselves in this case.
      So please leave your racism at home where it belongs. Not every politician or non black person is out to get all black people.
      As for the topic of this article. It is sad that so many are sitting in prison who are innocent. I do not believe that a person should be found guilty based on the accounts of witnesses. As a psychology major, much of the research I have read says that people who are in a stressful situation cannot clearly recall every last detail in an occurence and many times their mind subconsciously fills in the gaps when they are being questioned with false information. This man deserves a retrial.

    Left unmentioned in the article was the fact that earlier on the night in question, Troy Davis had been thrown out of a nightclub for thuggish behavior. Rather than go home and sulk, Troy decided to angrily pace around in the parking lot outside the club for a while. Some men eventually exited the club and upon seeing Troy, joked about his ejection as they got in their vehicle. Davis produced a handgun and opened fire on the men as they drove out of the lot, shattering the rear window and wounding a rear set passenger in the jaw with a slug. He then fled the scene. The slug, it was discovered, matched the ballistics of those which killed Officer MacPhail a few hours later. Davis' gun was used at both crime scenes, but this fact is omitted by the rabid pro-Davis supporters.

    Also of note, the alleged "real shooter", Sylvester Coles immediately went down to police headquarters following the shooting to say he was there and what he witnessed. Would a real cop killer tend to do that, in effect, putting themselves at risk of immediate arrest? Hardly. But what did Troy Davis do following the shooting? He quickly went back home, grabbed a few things and fled to Atlanta, where he was not found until three weeks later. What was he hiding from?

    The claims about witness intimidation by police could very well be taken another way. None mentioned any pressure from police at the original trial, most if not all were directly asked about that and all denied any such problem. This situation of new claims and eyewitness testimony could perhaps be spun from the pressure (either peer or directly suggested) of Davis supporters, who may be using guilt or intimidation factors to get these folks to "rethink" their testimony. The most accurate testimony would have come at the original trial, when the events of the night were most present in their minds. Numerous appeals courts and the Georgia Board of Pardons have all reviewed the claims of new testimony exhaustively, and have concluded that there are just too many doubts about their veracity to be accepted for consideration.

      Did Spencer Lawton write this? I only ask because so much of this distorted recitation of ???facts??? is much like the one Lawton offered last October.

      DISTORTION: The entire first paragraph. Are you even talking about the same? None of that is remotely close to the facts of this case.

      DISTORTION: Redd Coles ???immediately went down to police headquarters.???

      FACT: Redd ran from parking lot, and then hid from police as they searched the surrounding neighborhood for the shooter. Redd then ran to his sister???s house and immediately changed his clothing!

      DISTORTION: Davis ???quickly went back home, grabbed a few things and fled to Atlanta, where he was not found until three weeks later.???
      FACT: Davis remained at home the whole day following the shooting. He left for Atlanta a day later on a previously planned work-related trip. When he learned that the police wanted to speak to him, he voluntarily returned to Savannah within three DAYS.

      DISTORTION: ???None [of the now-recanting witnesses] mentioned any pressure from police at the original trial, most if not all were directly asked about that and all denied any such problem.???
      FACT: Two witnesses tried to recant at trial; a juvenile specifically said that the police threatened to put him in jail for 10-12 years if he did not implicate Davis. Another woman called the defense attorney within hours of her testimony and admitted that her testimony was perjured. She, like most other recanting witnesses, did not know Davis and had no reason to lie for him. A third person risked arrest to avoid committing perjury at trial.

      I do agree that ???there are just too many doubts about [the trial witnesses???] veracity.??? No decent person would want an innocent man executed for the sake of expediency. Troy Davis should be given a new trial.

      Mr Sylvester Coles was also at the "party" where Mr. Troy Davis allegedly shot at a car, in the dark, from 200 feet away; Mr Coles went to the police... after consulting with a lawyer; Mr Davis was not found...Mr Davis "surrended" to the police.

    The Troy Davis case and scenario is unfortunately not an isolated one!
    Over 1500 people and counting, have been exonerated from wrongful convictions, and thousands are presently incarcerated for crime they did not commit. Recantations have been one of the factors freeing many aside DNA, confessions by true perpetrators, thorough and independent investigations, acknowledgement and recognition of police and prosecutors misconducts. Not to mention that some wrongfully convicted have died in jail or been executed before their exoneration's. Mis-identifications and coerced testimonies are one of the most common reasons for wrongful convictions. In this case, the ball is passed from Court to Court and finality seems to prevail over fairness, truth and/or innocence. There is much more behind this case that the sole fate of a man. The entire justice system has become more than questionable for thousands of innocents.
    I now wonder, since focus is pointing to Mr Coles as the shooter, why we haven't heard from Mr Coles, living in

    The american legal system, as designed, was superb. Now it is one of the world's worst -- as evidenced by the largest incarceration rate in all the world. Its focus was once the protection of the rights of the accused. Now its focus is on "getting the criminals off the street," as if they are a different species. The source of its recent failure? The individuals who hold public positions in our court system, i.e., judges and proseutors. More than any group, these individuals have virtually destroyed the Great Experiment in overnment set forth by our founding fathers. I suppose it was to be expected, that a group of inferiors would some time emerge and destroy the Experiment. It is unlikely, now that these inferiors have advanced to the supreme court level, that we can regain what we have lost. It may have been forseen by some, but it was a surprise to me, that this would occur. It constitutes the greatest political loss in the history of the western world. Truly a shame and embarrrassment that america, above all nations, would become The Great Incarcerator. Mr. Davis is one among so many -- and, no, not all citizen victims of this tyranny are of color, In the Kafka-esque society created by these inferiors any of us can be imprisoned at any time -- with no relationship at all, no knowledge at all, absolutely no awareness at all of the cause at hand. We simply live out our lives in the hope that in some court, somewhere in this land the roll of the court/prosecutorial dice, in all its randomness, doesn't come up with our number. Such is america today.

    The burden of proof placed upon a convicted prisoner to overturn a jury verdict is, in most American jurisdictions, is evidence (1) that is so compelling that, had they heard it, no reasonable juror COULD have voted to convict him; AND (2) that was not discoverable by reasonable diligence at the time of the trial. This burden is almost insurmountable... virtually the only exception for many years has been DNA extracted from semen stains in rape cases... although verdicts of conviction in many other kinds of case rest upon evidence even more tenuous than those of the rape cases, sound, dispositive evidence of INNOCENCE is much harder to come by. Its almost a certainty that we have already executed people who were innocent of the crimes for which they were condemned. It IS a certainty that we currently imprison some thousands of people (we can argue the number...the US Dept of Justice Bureau of Justice Statistics admitted that the number could be as high as 200,00 sentenced prisoners) who are also innocent of the crimes of which they were convicted, most of whose appeals have or will come to nothing.

    This is only part of the reason that 20% of all prisoners on the planet are those held in U.S. jails or prisons.

    Land of the Free. Right.
