No, but I would have HOPED (oops, there is that pesky magic word again...) that common sense and intelligence would outweigh the fact that she was nominated because she is an Hispanic woman with minimal legal qualifications. I was under the impression that justice is supposed to be blind - hence race and gender should not come into the picture, rather the President of the United States would intelligently nominate a fully qualified individual based upon legal experience and qualifications rather than race and gender. Oops, I forgot, the United States doesn't have a President, we all now live in La-La Land where the magic words Hope and Change miraculously make things OK (as long as you and I pay for it with more hidden taxes). Hardly. As a college professor, I can attest to the fact that many students with terrible writing skills end up in college - it has NOTHING to do with affirmative action. There is absolutely no reason to assume that her admission to Princeton had anything to do with Affirmative Action.
Moreover, Sotomayer's track record (lawyer, judge, etc.) seems to prove what supporters of affirmative action have always contended: give qualified minorities a chance and they will succeed. In other words, Sonia Sotomayer is hardly a case-study in the "evils" of Affirmative Action.

If they want to call it Affirmative Action let them go ahead but I am a third yr college student from a foreign country who Affirmative action was not a benefit for me as I pay my own way through college but yet I am subjected to sitting and listening each day to non minorities who were born right here in the land of opportunities unable to read at 10th grade level much less college level and their writing is also ridiculously appauling, maybe they would have benefited from Affirmative action. Atleast Sonia Sotomayor made use of Affirmative Action if thats what she received. And yes I am enrolled in an Ivy league institution.

Also, so far it appears that Sotomayor ruled from the bench in such a way only insofar as to make herself a plausible candidate for the SCotUS. She has also made it clear through her speech that she would rather allow race to be a contributing factor for qualification to high postings, and I would expect, once she is confirmed (and her position is secured for the remainder of her life), that she would be extraordinarily outspoken on the matters of race vs qualifications.

My point is that, absent evidence to the contrary, there is no reason to assume that affirmative action had anything to do with their admission. There is no evidence that Sotomayer was the recipient of affirmative action in any way.

As for your second "point," her speeches regarding "a wise latina" having a deeper insight are troubling. Based on what I have read, her point was that her life experiences have shaped both shaped her interpretation of the law and made her wiser. The fact that she racialized it is troubling and is definitely something that she ought to explain during her confirmation.
Now, as you can see, I constructed an argument WITHOUT resort to name calling - it's called "civil discourse,' and it's a cornerstone of civil society. Why dont you practice it? Class dismissed.

Why refer only to 'conservative critics' (without true attribution) who say that she will reveal her carefully hidden radicalism once she is on the Court? She has been hiding this radicalism for over 30 years; she is really good at it.
I don't think she is a closet radical based on what I saw. Everyone has a particular bias towards one's culture and anyone telling you different is a liar. Sometimes this slips out embarassingly when one's guard is down, but she has not made a habit of such slips and according to her record has not made a habit of ruling in such a fashion. Make no mistake about her being a liberal, but she is replacing a liberal justice and this doesn't change the makeup of the court. I am fairly good at spotting closet radicals, especially when they are under pressure and off their guard. Senator Sessions did a good job trying to unglue her and bring this side of her out and I just didn't see it. Her responses to Senator Hatch were erudite, so she did not appear to be intellectually underqualified. To me it appears that she passed this test fairly well and she was not treated with kid gloves. The general public was split on her nomination before today and if she slipped badly she would have been dropped even by her democratic supporters. Contrast this with the Miguel Estrada performance if you will. After her performance, I dont think that for republicans this is a battle worth fighting.

I am watching the Senate judiciary hearings now and it is fairly clear to me that she is a liberal but not an extremist or fringe judge. Aside from her compelling testimony, evidence from analyses of her rulings indicate this fairly clearly. Considering who she is replacing on the bench, I no longer have any objection to her appointment. If and when Obama gets to replace a conservative judge, it will be very interesting to see whom he then chooses.
I wish judge Sotomayor the best. I am sure she is qualified for her new task, and I think she is an adequate choice for
the crucial position she is going to hold. There is always a personal note in a judicial decision, and her critics should be
aware of their own bias which is quite obvious sometimes.

She suggested that court decisions SHOULD reflect those biases. A judge should not be biased and should judge all equaly and supress any inclination to help "their own". They should be color blind and see only the law and the merits of the case.
As for Obama, since Columbia University admitted a person who by his own account was less than mediocre throughout his 12 years of being a student and mainly focused on playing basketball and hanging with his friends, as his extra curriculum activity, then, they surly found a different reason to accept sub- par students.
In order to get into Harvard Law School Obama used the same ticket- his race and "story" but it wasn't enough- so he had to take a year to be a community organizer and add that to the same ticket.
HE didn't get into Harvard Law School thanks to his academic achievements or being a so- so high school student, doing so- so in corporate world (he worked for a couple of months in a firm in NYC) and had he been with the same grades in high school and the same "playing basketball" as academic highlights in his personal statement- you would never see his name in Harvard or Columbia.

Republicans are worried that Sotomayor will be biased in favor of minorities. They prefer another white judge who will be biased in favor of white interests. An activist judge is a judge who opposes the normal and usual advantage that white businessmen could always expect in the courts. Nothing could be worse for their cause than a justice who was actually just. Watch the good old boys try to rattle Sotomayor during the hearings and remember that the real issue is that she is wrong for the job because she is not white enough.
As I look around the globe today, I look for places where the majority of the population is non-'white' and that same non-white majority are running thier respective governments and I say...Wow, I sure would love to live and prosper here...NOT! I have noticed where whites settled and established governments that they seem to be the economical, political and military powers that be, what a terrible track record for these people...shame on them!
How about choosing a judge that is not biased and sees only the merits of the case, the law, and justice?
Why look at people and add their color or race into the equation. We are all people and should be judged equally.
Why should a firefighter be deprived of his promotion, solely based on the color of his skin?
If you want to help minorities help their education perhaps, but taking away a promotion from a law abiding citizen, just to give that benefit to someone who did not earn it based on his merits, is simply discriminatory and racism.

In the first place, your statement is overly broad and untrue - the Japanese have had a stable government for over sixty years, and there are other non-white countries that are doing just fine. For the non-white countries that have unstable governments or are mired in poverty, I would point out that many were objects of white colonialism, which left a lasting legacy of corruption.
Obviously, this is a complex subject that cannot be fully explored in this venue, but what you wrote is pretty racist.
What should also be mentioned is that there are plenty of nations founded by whites that have failed along side nations that weren't found by whites? So, exatly what is the point?
All races of the human species have experienced slavery, bondage, oppression, tyranny, etc. My point is that in this melting pot of peoples, we were to form one nation with equal rights irrespective of the color of your skin. I don't recall anyone "knockin" white-cigar smoking men, just pointing out that part of what made this country possible was racialized violence and unfree labor in various forms (slavery for Africans, forcibly taking Native Americans' land, laws that eseentially reduced Asians to slaves in the west, etc.). While a vision of the United States as a race-blind utopia is a good goal, we're not there (look at the recent case where black children were denied entry to a community pool in suburban Philadelphia). The reality is that whites in this country continue to benefit from centuries of oppressing non-whites - look at the appallingly high rates of poverty in black and Native American communities. The reality that whites continue to control a disporportinate share of the country's wealth undermines your argument that whites are somehow discriminated against.

I would also like to point out that the first slaves in America were poor white people that were brought over here with the hopes of working to pay for their trips to America but could never work off the debts because they were lied to and could not read the documents they had signed that said they had to work for fifty or more years and so did their children to pay for the trip, which back then was more than a life time so, they would escape into the countryside and blend in with other white people. That is why when one group of blacks in Africa offered to sale other groups of blacks to rich white people they bought them. When they escaped they could not blend in. Make sure to read the part about --ONE GROUP OF BLACKS WHO SOLD ANOTHER GROUP OF BLACKS!!!!
One other thing is that If you took a look around the world and actually did some research you would find out that there are more rich minorities in America than almost all of the rest of the nations put together and that the poorest minorities in America are still wealthier than most of the other nations minorities.

Very little of what you say is true. The most important point is that just because YOU personally are not rich does not disprove my point, which is that whites (as a race) own more wealth than blacks. Moreover, the "average" white is better off than the "average" black - you may be a statistic underachiever.
While it is true that there were a number of indentured (white) servants in what became the United States early on, it's important to remember a few things: first, indentured servitude (unlike slavery) has a fixed ending point (usually seven, but sometimes as many as ten, years - certainly not fifty). Second, servants' masters did not "own" indentured servants or servants' children the way that slaves' masters did. Finally, I am not sure what point you are making when you point out (correctly) that some Africans sold others into slavery. Is your point that that makes slavery alright?
As for your last point, that Sotomayer is a racist, I would challenge you to prove that by actually citing her statements or decisions to support your assertions.

to be honest with you, test scores should not be the only factor in determining qualifications. i would hope people have more depth than a single number on some test. high scores are good, don't get me wrong. but character and judgement definitely make a difference as well. is there any chance that other things may have been taken into consideration? does background really not matter? please give some credit to the differing experiences that come with culture, race, ethnicity, etc.

Senator Feinstein said it like it is: Republicans shout about what they call the "judicial activism" of the other side. Democratic Presidents have tended to be overly cautious, even mildly timid. Republican Presidents have acted boldly to install justices with extreme right wing views. They have used the euphemism of "strict constructionists" to secure their wishes. Thus have they installed unabashed rightists such as Scalia, Clarence Thomas and Alito. Democratic appointees to the bench are mildly left of center. The court cannot become a citadel for ordinary citizens, especially minorities (gays, lesbians, ethnics, women, religious groups, atheists, etc) can ultimately retreat if they ignore issues of equity and fundamental justice. That is what is wrong with the current composition of the Supreme Court! Right wing judges routinely trumpet a hard vision of ideological finality. Yet, the law is not mathematics with very predictable results. Rightists, unlike Democrats, deny that they put their own particular gloss, cultural predispositions and philosophic orientation in their interpretation of the constitution. Hamiton was wrong when he asserted in No. 78 of The Federalist that the judiciary has "neither force nor will, but merely judgement." Frankfurther reminded us that "It is the Constitution we are interpreting, not an insurance clause in small type," that "it is inadmissibly a narrow conception to "disregard the gloss which life has written upon them."" Therefore, empathy and life experiences matter. Since the Constitution is not exhaustive, it leaves judges with lots of room to do what they want!

I respectfully disagree. I agree entirely with what Hamilton was trying to say. To properly administer justice one must be careful to exclude personal biases and "will" and not allow them to cloud one's judgement. A justice should be trying to interpret the intended meaning of the constitution (the founding father's intentions and wisdom) and established legal prescedent as it applies to the greater good of the community in light of ambiguities presented by the advances in modern society. The notion of imposing one's personal agenda and biases on the process causes one to lose sight of what is best for everyone which was the intention of those who wrote the laws and ruled before. This mistake is one founded in arrogance and narcissism and quite unfortunately is typical of modern day politicians. It saddens me to see this kind of attitude inflitrate the court system so pervasively up to the very highest levels. To put it simply for the supreme court, projecting the intentions of the constitution onto modern day conundrums is their primary function. Projecting their own personal biaes should have no place or relevance to their decisions. If a prospective justice is not up to this standard based on their prior record then they are not worthy of being there since they will serve to change what this nation is about in a negative fashion.

The problem is that we don't promote the best and the brightest but rather look at great "stories" and "backgrounds". So since her story was what got her those opportunities, she thinks that's the right way to judge a case- not by the metirs, but rather by the personal statement that can get you to an Ivy League school without having the academic achievements to back it up.
Obama supports her, because he, too, got into Columbia despite being a mediocre student at best throughout his 12 years of being a student.
It was his "story" that got him to Columbia, and then to Harvard Law School.

As for President Obama, Columbia is not in the business of accepting sub-par students, and there are plenty of highly qualified students with compelling stories on Harvard Law's waiting list. I have come across no evidence to support your claim that he was "unqualified" for either institution.

In 1917 the USA granted American citizenship to all residents of PR. Ever since , we have served in the USA government as civilians and military, we are not foreigners, we are citizens just like you. We do not need a passport to travel between the USA and PR, we are an island located in the Caribbean sea, look at a map, also check via internet information of PR, enlightened yourself because you really need it. I served in the Army during Vietnam, I know what is to be treated by other fellow Americans as a foreigner, I know what is discrimination, any American citizen or legal resident in the USA has the right to work and live a productive life, regardless of race, color, etc... At least that's what the USA Constitution establishes.
