Oregon officials on Thursday announced the rearrest of Ty Sage—a 26-year-old charged with second-degree murder and first-degree robbery—after he was mistakenly allowed to post bail, authorities said.

“Ty Sage should never have been able to post bail,” Multnomah County Sheriff Nicole Morrisey O’Donnell said in a statement. “To the family of Lowgunn Ivey, the young man killed, I want to acknowledge the fear and trauma that this mistaken release has caused.”

Why It Matters

Sage is charged in the slaying of Lowgunn Ivey, a 15-year-old killed in 2021 during a drug and gun sale setup, according to court documents obtained by KATU.

What To Know

Sage appeared before a Multnomah County Circuit Court judge for a bail hearing on September 17. The county Sheriff’s Office said a preliminary review suggests that the department misinterpreted a court order signed that day and filed one day later. A full inquiry remains ongoing.

An initial release order “indicated his bail had been set to $5,000,” Morrisey O'Donnell said, per ABC News. But Sage had been denied bail, according to court documents obtained by the outlet.

The sheriff’s office arrested Sage with assistance from the U.S. Marshals Fugitive Task Force around 1 p.m. Thursday. Officials said he was apprehended at a gas station off Highway 101 in Florence, Oregon, without any use of force.

The sheriff’s office said Morrisey O’Donnell spoke with Ivey’s family to share news of the arrest.

What People Are Saying

Morrisey O’Donnell, in a statement: “Lowgunn’s family deserved better. As Multnomah County’s sheriff, I am committed to making sure this does not happen again, that we learn from our mistakes, and that Lowgunn’s family can have justice.”

Jodie Ramsey, Lowgunn Ivey’s mother, in comments to FOX 12: “I feel a little bit of relief knowing he is back in custody. I do have to say I did have some serious doubts this would happen but I’m glad that this was able to happen in a timely manner.”

What Happens Next

The Multnomah County Sheriff’s Office said Sage will be booked into the Multnomah County Detention Center on a no-bail hold. The incident remains under investigation.
