Police Officer Charged With Masturbating During Home Call Out

A California police officer is facing indecent exposure charges after being found masturbating during a home call out in San Jose.

According to the Santa Clara County District Attorney, the 32-year-old officer, Matthew Dominguez, allegedly masturbated at a San Jose family's home last month, after being called to the house because of a disturbance.

On April 21 at 6:30 p.m., the San Jose Police Department (SJPD) received a call about a mentally ill family member - the family's son - who had become violent. Dominguez was sent to the home with two other officers.

Dominguez took the lead investigative role, according to a statement from the county's D.A., and started talking with the family's 23-year-old daughter about her brother's location. According to the D.A., Dominguez "took interest in her and continued talking exclusively with her."

The officer then sent his colleagues away to locate the subject, according to the Santa Clara County D.A.'s office. After they were gone, the body-worn camera Dominguez was wearing shows him following the daughter around the home. Forty minutes into the investigation, the woman went to retrieve her brother's GPS and brought it to the officer in the area between the dining room and the kitchen where he and her mother were waiting.

Dominguez then allegedly unzipped his pants and started touching himself in front of the two women. The mother then sent her daughter to fetch a glass of water, and as she was gone Dominguez exposed himself to the woman.

Mother and daughter then fled the house and called for the husband/father and an uncle who lived nearby. The women reported the officer's behavior to the two male relatives, and the father then ran inside the house.

He found Dominguez with his exposed, erect penis in his left hand and his right hand on the kitchen counter. When the two men made eye contact, the father left the house.

A few minutes later, the D.A. reported, Dominguez walked out of the house and went back to work.

The two women who had witnessed the officer's indecent exposure reported the incident to the other two officers on the scene.

Dominguez had been with the SJPD for four years, according to the D.A.'s office, and he's now on administrative leave. He was arrested on Thursday and will be brought in front of a judge to face the charges against him on June 22, at 9 a.m. PT in the Hall of Justice in San Jose. There's an ongoing investigation into the incident, and the Santa Clara County D.A. is looking for any additional criminal information about Dominguez.

If Dominguez is found guilty of the charges against him, he could face a year in jail on top of being placed on the sexual offender list for 10 years.

"The charged behavior is beyond disturbing," District Attorney Jeff Rosen said, as quoted in the D.A.'s official report of the incident. "Law enforcement officers respond to our homes to help crime victims, not terrorize, traumatize, and create new victims.

The incident is the latest in a line of serious transgressions recently committed by SJPD officers. On May 5, an SJPD officer was found intoxicated while investigating a baby kidnapping; in mid-March, a 24-year-old rookie SJPD officer was found dead in his flat following a fentanyl overdose. Another officer is now on administrative leave after having been found to have traded a meth pipe with a woman for information on a case last year.

Talking in a Facebook live on Thursday, San Jose Mayor Sam Liccardo talked of a "serious problem in the SJPD" that requires immediate action. Liccardo and San Jose police chief Anthony Mata agreed that they have "much work to do" to improve standards.
