An 11-year-old girl died Monday after she was struck by a stray bullet in a bungled drive-by shooting on a street in the Bronx borough of New York City.
Both of the students who were injured were in stable condition, the New York City Police Department said.
The Trump Organization sued the city in June and was granted a victory in the case Friday.
All the victims reportedly died of smoke inhalation.
The lawsuit stated that the city and the landlord had "actual notice of defective conditions" at the building when the fire broke out.
"Their neighbors on the higher floors never came out and they were safe, so I thought that maybe my brother also was safe in the apartment."
The Twin Parks apartment complex had several fire safety hazards that likely contributed to Sunday's deadly blaze.
The doors, which should have closed automatically, are suspected of malfunctioning and allowing clouds of smoke to choke many hallways in the building, fire officials said.
Residents believed the sound was a false alarm. "So many of us were used to hearing that fire alarm go off, it was like second nature to us," said one resident.
On Monday, the New York City mayor reminded residents to shut doors behind them when escaping a fire.
"This is going to be one of the worst fires that we have witnessed during modern times," NYC Mayor Eric Adams said.
The deadly fire was caused by a space heater, fire officials said Sunday. Live updates for this blog have ended.

The video shows two groups of people exchanging rapid gunfire on a street in the Bronx last month. Police are now seeking the publics help to identify suspects.
The NYPD identified the victim as a 32-year-old male who had gotten into a verbal dispute with one of the suspects at a party.
"They were out for an ordinary day at the beach. Once the rain started they got ready to leave, and out of nowhere, they were struck."

Oliver, 34, has been charged with attempted murder in connection with the June 20 attack.
The NYPD is working to identify the suspect in the video but said the individual is wanted for questioning in regard to "multiple acts of criminal mischief that occurred within the confines of the 50th Precinct within the last week."
