The 50-year old mom is seeking joint legal and sole physical custody of their five children, Liam, 17, Stella, 15, Hattie, 12, Finn, 11, and Beau, 7. She is allowing for McDermott, 57, to have visitation rights, the specifics of which will be decided later. She also seeks spousal support and has requested that McDermott cover her legal fees. Just a few days prior, Spelling was seen crying in her car after a tense discussion with McDermott at a storage unit. The confrontation saw the overwhelmed actress gesturing broadly and seemingly yelling at her husband, who eventually walked away from the dispute.

In June of last year, McDermott announced on Instagram that he and Spelling were parting ways after 17 years together. Subsequently, he explained the reasons behind his decision to make the announcement, a post he has since removed. He told Daily Mail, "My worst memory with Tori is that last fight when I was drunk and angry. It was the night that I raged against her and the children and I saw the light, the final flicker of the flame go out in her eyes... I posted that because I was at the end of my rope. I didn't know what to do. I had burned everything down yet again."
